TV Uses My Photo - Minus Permission!

First and foremost,

Thanks to Gerry Hill and Andreas Kratz...

To put it simple, SVT TV have used my photo with out permisson and credited it as them!! I have recieved an email from the company, however only now I realise they never waited for my reply.

So, what do I do now and what price to I command... The scary thing is, I have had reports the photo was used on TV aswell as the web - Any scandinavian a.net's out there let me know if this is indeed true...

Any help, and fast would be most appreciated!

When I saw the news they stated that the pictures were found on a site for aviation enthusiasts.

In my opinion they need punishment for meddling in the CIA's business. I don't mind for 1 second if Tangos are transported via Sweden and Europe. Go ahead!

I've quite a few problems with this one as it has been usually used without my consent by quite a few shows without my permission...

And to be frank, I haven't been getting any compensation, despite the emails sent to them.

Good luck - Many European TV news channels used my picture of the ill-fated Bellview 737 which crashed in Lagos last month, none with permission or credit. I chased after BBC World and they are 'looking into it', and I'm sure it will lead to nothing....

My opinion is that the transports of terrorists from the warzones to Guantanamo etc should not be blocked by countries that are terrorist friendly.

As there a TV company i would ask for quit a few thousand say like 7000 pounds as they dont want no bad press as it will reduce viewers so name the price and im quite sure theyll pay it

At the moment I am waiting for the "picture editor" to contact me. They have apologised and confirmed they did make a mistake - they did not to tell me that, it was quite obvious!!

Anyway, no price has been agreed but they are starting to wind me up so I was thinking of asking for a £1k maybe more... Something telling me that it may be a cheaper and less profile issue for them to pay instead of me seek legal action.

"SVT has a right according to the Swedish Copyright Law - following the rules of extended collective agreement - to broadcast a photo without the permission in beforehand by the rightowner. However SVT has a corresponding duty to pay for the use. "

Is the first comment indeed true, are they trying to fob me off?? Can anybody let me know of any good photo copyright law websites?

If that is how they do things, then you can name your price! That is like having work done on your car and not negotiating a price for the labor. The mechanic can charge as much as he wants now the car is fixed. I would up it to £2500 (or find that camera you have had your eye on). The damage has been done, now they need to pay up!

I have emailed the contact above (Jan's forward address) and will await his reply. I cant believe a week on from the copyright breach that I am still waiting for any concrete fee from SVT.

Am very angry they seem to be calling the shots, when in my opinion they dont have a choice - You stole the photo, you pay up! I have to wait for their fee and go from there.

Still, we'll see what Staffan has to say.

I'm feeling quite tempated to take the photo out of the database. The TV station do not answer my emails and since I know nothing of the British law on copyrights I don't know how to act...
