One of the conditions when the current owner bought the operating certificate and certain other assets out of bankruptcy court in Jun-1998 was that the FAA only allowed them to operate a maximum of 8 or 9 aircraft (it was 8 or 9, I don't remember which). I'm not sure if this "rule" passed and the current stipulation is another, but you should notice that the FAA website indicates that they only operate 7 aircraft with the current certificate (while they have already acquired most of the 24 727's). I would guess the stipulation is still being enforced. Presumably, it would have to do with their fitness to operate more than "said" aircraft.
