What is to be considered the 'home state' (third freedom) of a
carrier 'operating' in a foreign country?

... Joshxx, could you kindly rephrase your question, because I don't understand it.

3rd freedom rights are the rights to operate from the country of which you are a national to another country. UA is a 'third' freedom carrier from the US to Germany, or the UK, or Japan, etc.
4th freedom is simply the opposite the right to operate to the country of which you are a national.
5th is freedoms to operate between two foreign countries (in conjunction with 3rd/4th freedoms - i.e. Qantas has 5ths between Singapore and the UK (used in conjunction with their 3rd/4ths Australia - Singapore and Australia - UK.

If you are talking about cabotage (domestic) operations by a non-national those are 8th freedom (unofficial - not defined in the Chicago Convention)

ANother, thanks for replying. If a representative at UA 'German bureau' is looking up that traffic Germany to US, is that individual talking about 3rd - 4th or 4th - 3rd freedom flights??? Hope it helps??? Thank you.

In case anyone is unfamiliar:
  • First Freedom:
    granted by one nation to another nation or nations to fly across its territory without landing.
  • Second Freedom:
    granted by one nation to another nation or nations to land in its territory for non-traffic purposes.
  • Third Freedom:
    granted by one nation to another nation to put down, in the territory of the first nation, traffic coming from the home nation of the carrier.
  • Fourth Freedom:
    granted by one nation to another nation to take on, in the territory of the first nation, traffic destined for the home nation of the carrier.
  • Fifth Freedom:
    granted by one nation to another nation to put down and to take on, in the territory of the first nation, traffic coming from or destined to a third nation.
  • Sixth Freedom:
    the right or privilege, in respect of scheduled international air services, of transporting via the home nation of the carrier, traffic moving between two other nations.
  • Seventh Freedom:
    the right or privilege, in respect of scheduled international air services, granted by one nation to another nation, of transporting traffic between the territory of the granting nation and any third nation with no requirement to include on such operation any point in the territory of the recipient nation, i.e the service need not connect to or be an extension of any service to/from the home nation of the carrier.
  • Eighth Freedom:
    the right or privilege, in respect of scheduled international air services, of transporting cabotage traffic between two points in the territory of the granting nation on a service which originates or terminates in the home country of the foreign carrier or (in connection with Seventh Freedom operation) outside the territory of the granting nation.
  • Ninth Freedom:
    the right or privilege of transporting cabotage traffic of the granting nation on a service performed entirely within the territory of the granting nation (also known as "stand alone" cabotage).

    Traffic originating in Germany and destined to the US travelling on United is 4th freedom. The same passenger travelling on LH is 3rd freedom.

    3rd/4th are almost always used together - indicating traffic BETWEEN the two countries.
