When the WN plane ran off the runway at MDW this winter, IIRC, the family is/was sueing WN....wether it be because of pilot error or whatever, the main fact is that the family is sueing WN.
Let's say you are at SXM, and a KLM 747 is on approach, clips the fences and happens to hurt/kill someone....can KLM or whoever be responsible? Or would they claim that a person shouldn't be on that fence in the first place? Would it be the end of Maho Beach?

But to try to answer your question: They have a warning sign at that beach warning from the aircraft. So as long as they dont actually clip the fence or anything similar, every person standing there or being in the area is responsible for themselves.
