lets wait for more. this still would not explain the switched off responder, therefore no TCAS actions...

But it would seem from the report that an ATC error put the aircraft in danger:

"According to Folha, the flight recorder shows American pilot Joseph Lepore receiving instructions from the tower in Sao Jose dos Campos to fly northwest at 37,000 feet "until Eduardo Gomes," the airport in Manaus. That altitude contradicted the pilots' filed flight plan and as an odd-numbered altitude should be reserved for southbound flights."

The Legacy pilots may have been errant in that, but:
  • If the Legacy was where the tower thought it was
  • The 737-800 was where the tower thought it was
  • The Legacy followed the tower's instructions
  • The 737-800 followed the tower's instructions

Then the fault has to be with the tower. What if the plane didn't have TCAS? This accident would have happened anyhow.

No it wouldn't have. This is a classic example of the purpose of TCAS.

What? I don't think you read what I said.

My assertion was that if the planes involved lacked collision avoidance (and many do), then there still probably would have been an accident under these circumstances.
