Can’t Reach Anyone At Pan Am

Now don’t get me the “they went bankrupt long ago” .. I know that   Now it’s about me contacting someone from the PanAm legal department for logo and material usage for the following project:

I have hours of old PanAm movie material from the 1950s, 60s and 70s, commercials, marketing movies …. And I wanted convert those old 16mm reels professionally to digital movie and put them all in a neat DVD box depicting the golden era of jet age. I believe there’s a big market for those films, both among enthusiasts and average people with a sense of nostalgy. Rememebr the small comic guy in the “PanAm makes the going great” ads? He as well will be on the DVD with plenty commercials.

I know that the copyrights of all old PanAm material now lies at PanAm railways, I emailed them many times within the last months, everyone, from marketing to legal, noone replied. Letters remained unanswered, and on the phon they told me they would reply by email …. Nothing happened.

My request was polite, professional and of the same kind I asked other companies before, with great success, I asked them for a quote for the usage, offered close working together with their marketing deparrment, and off course would have sent them several copies for reference.

I know there’s not much I can do …. But what shall I do? It’s impossible that such a project fails under the utter “ignorance”. The DVD is ready so far, it’s brilliant, but I won’t publish it withour prior written permission from PanAm.

If I am not mistaken the panam guys you are trying to contact finally where able to close the file on panam because libya paid panam for the bombing of panam 103 and that was the final outstanding return from original panam once that was paid out they shut down. i think you have to contact the people of "new" panam or try contacting the panam store in miami located in the panam flight academy they might be able to help you.

Check with the folks at Pan Am Flight Academy...they have use of Logo and name and may be able to point you in the right direction.

No, I contacted PanAm railways, who appear to be the big company housing also a now rebranded New England commuter Airline, the PanAm flight as well as the aforementioned railroad

Unfortunately, there is not much else to do except keep trying. I believe (and someone can correct me if I'm wrong) that Boston-Maine (or Guilford Transportation) owns the rights to the name and logo. It's a shame really that a company like this can drag the Pan-Am name down

The legal wheels turn slowly and your request is being positioned by priority....which is quite low in the grand scheme of things.

You were very wise to question what you are doing without permission. The Pan Am Airlines logos, trademarks and such are still in force. In fact, the globe logo was re-registered just last week.

Then select "New User Form Search (Basic)" and enter the term "Pan Am"

There are 43 hits, of which only four or five relate to Pan Am Airlines. "Pan Am" is not exclusive to the air lines, but the logo and several other trademarks are and they are protected. You cannot sell your DVD without permission. I am sure Mr. Nishi would be happy to sell you a license to use his logos and such.


I just noticed that Mr. Nishi has an application in for the Logo on Pens, cups, mug and such so he is planning on selling the useage rights for such. It is the 5 of 43 hit. (serial number 78899615). That tells me he will be very tough if you mess with his trademarks without permission.

but would Mr Nishi be the right person to contact? He only seems to be the Attorney that advised PanAm in claiming the rights and patents, but is he working for PanAm or was he a hired external?

On the otehr hand, who would be the owner of the rights on the old 1960s commerical movies? Where can I see wich part of the old PanAm portfolio package went into wich hands?

Exactly correct. He is the attorney of record for the trademarks and probably copyrights as well. He therefor knows who you should contact.

A word about copyrights. Everything published in any media in the USA since 1923 is most likely under copyright. That means each and every one of your film clips are copyrighted and you will need permission for each. Those that were created for Pan Am are most likely under Mr. Nishi's control, but other clips may have come from movies, TV productions or other third parties. You will have to do due diligence to determine who are the copyright holders, and contact each one, and get WRITTEN permission.

Here is the gotcha, let's say you have a old Burma Shave commerical what has a Pan Am plane it it. There are several rights involved: There are copyrights on the commerical itself, a trademark on the logo on the plane, background music copyright, performance rights, etc. etc. You need permission for all the rights to use the clip in a commerical enterprise.

While I am not an attorney, I am a publisher and so have had first hand experience with this sort of crap. You think you get permission from someone who claims to have the rights only to discover that there are others with claims. You really want to talk to a lawyer who specializes in copyright and trademark infringement. US copyright law is complex, and when you come to international issues, it is mind boggling.
