Lawsuits Filed For September Gol 737 Crash

Quoting The Miami Herald:
A series of lawsuits were filed Friday in federal court in Miami seeking millions of dollars in damages for alleged negligence stemming from an aircraft collision that led to Brazil's worst air disaster.

The 16 lawsuits, filed on behalf of family members of some of the 154 people who died, contend that several problems combined to cause a collision between an Embraer Legacy 600 business jet and a Gol airlines Boeing 737, which went down in the Amazon rain forest Sept. 29.

''I think we're going to find out, like in all of these tragedies, that it wasn't a single mistake It was a series of mistakes,'' said Steven C. Marks, lawyer for the families filing the lawsuits.

A precise damages dollar figure is not mentioned in the court filings, but Marks said it would be in the millions of dollars.

The airline and the pilots of the USA based (Long Island, NY) company that crashed into the GOL a/c, the makers and maintainers of the transponders and others. Foreign nationals can sue in a USA Federal Court, espceially where a potential and resonable Defendant is domiciled or has significant investments in the USA. Of course, the Brazilians got a big time 'ambulance chaser' working on a 33%+ piece of the judgement or settlement IF they win, something that can't do in a Brazilian court. Apparently there has been other suits filed in other USA Federal District Court. This case was probably filed in Miami as closest large city Federal District Court to Brazil.

I think it was a charter company, not a part 121 airline. I think they'll have a very difficult case proving negligence on the part of the Legacy pilots. If ya can't prove negligence, there won't be any punitive damages, which we all know is where the real money is.

Not exactly on topic, but I am so "jarred" by the circumstances of this collision, that it happened in an airspace so large and with so few flights in the air at one time, that the larger plane with so many passengers was lost and the smaller plane on a ferry flight survived. I mean, it blows my mind that so many remote factors had to come together for this to happen and it did. So to heck with giving mental odds to "this flight" being probably safer than "that flight". I would have given you millioms to one that this would never have happen. So much for the argument that if we all learned to fly a personal plane it would be much safer than autos on the ground because of the vastness of the air space compared to the surface. I've heard that argument many times by those developing low cost personal planes.

Will be a hard legal case to sort out I'm sure. Wonder how much insurance the USA based company has?
