Shanghai Plane Crash Victims Win Damages From Korean Air

SHANGHAI, Feb 7, 2001 -- (Agence France Presse) In a landmark case, Korean Air has been ordered to pay damages to Shanghai residents affected when a cargo plane ploughed into a residential district here two years ago, reports said Wednesday.

The case is the first in which a foreign airline has been sued for damages on Chinese soil and follows a crash on April 15, 1999 when a Korean Air plane plummeted to the ground shortly after take-off from Shanghai, the China Daily reported.

Three workers on a construction site on the ground were killed along with all the Korean Air crew members, while dozens of locals were injured.

The flying wreckage and shock waves damaged buildings around the crash site prompting 37 residents to sue the airline for damages.

They demanded a public apology from the company and seven million yuan (843,000 U.S. dollars) in compensation.

In December No.1 Higher People's Court of Shanghai ruled Korean Air should pay them between 80,000 to 120,000 yuan (9,639 to 14,458 U.S. dollars) in damages, the China Daily reported.

Neither side has launched an appeal against the verdict within the time fixed by Chinese courts so the compensation claims stand unchanged.

Korean Air officials could not be reached Wednesday for comment.

Initially the 37 Korean Air crash victims said the compensation they received was not enough to repair their damaged homes and pay for the psychological trauma they suffered, the paper added. ((c) 2001 Agence France Presse)
