A small bit of news. First I had no idea that Fedex was going to sue ATA. This small writeup mentions specifics that I have not read or heard anywhere else. The link to Northwest as charged by ATA does surprise me though. Maybe some Fedex members or former ATA staff people here will know more.

This is in response to the original lawsuit ATA filed a few months ago against FedEx alleging they violated the existing contract and removed ATA from the team in January for the 2009 allocations. This was done prematurely to give the business to NW which is already part of the FedEx Team. The ATA/FedEx contract was through 2010.
This is basically a counter-suit that ATA did not fulfill its existing contract obligations for 2008 which end at the end of September because they shut down on April 3.
I am no law expert, but there are valid stances on either side of this so I see some type of settlement. The problem I saw originally is why in the hell ATA didn;t file the lawsuit back in January BEFORE the shutdown. It may have avoided the inevitable.
