AA's Answer In US-Russia Codeshare Case

AA, which has asked for three codeshares to Russia, says it isn't fair that Star Alliance could get three approvals (UA, CO, and US), Skyteam two (DL and NW, devolving eventually to one, I suppose) and OneWorld only one (AA).

They also argue that both CO and US asking to share with Swiss over ZHR is redundant and a waste of hub coverage, but the alliance argument is perhaps novel - at least I haven't seen it used before.

DOT's response may be precedent-setting on the issue of alliance parity.

I'm not sure if that argument will work for AA.

I'm not commenting one way or the other on the merits of the argument, but I do know that AA has used the argument before - the China case comes to mind specifically - without success.

AA is also asking for a full carrier selection proceeding, which the other carriers are opposing. So there are more issues than one in play.

Still, I hope DOT directly addresses the alliance argument in their response. Route awards to carries are more or less permanent; but alliances aren't - yet, anyway.
