This is definitely new BA First - the additional window covering that houses the electronically operated blinds is a dead giveaway.

Maybe he took stuff out of his pockets, hence his wallet is there as well. You can also use them in flight when flight safe mode is on.

Why not? Airlines offer now phone/sms/email services, or maybe he was taking pics for an a.net tripreport? Or, like I do, use it as a watch/alarmclock.

Seriously. Any cell phone manufactured post ~2002 has an airplane mode, not to mention the availability of the inflight services mentioned above. Virtually no one actually deactivates the mobile wireless services anyway. I think the collective flying public has realized the affect of a cell phone on aircraft instrumentation is remote to nonexistent.

It's 737s, 747s and 380s. Not 737's, 747's and 380's. Learn to use the apostrophe for crying out loud.

Yes, seriously. The airline I fly the most doesn't allow cell phone use in flight AT ALL. In fact it is a national regulation in this country.

Well, I apologize. I assumed that you had flown internationally, or that the fact that cell phones had an "airplane mode" might have given away the fact that one sitting on a tray table does not constitute a felony in the majority of global airspace.
