How is a flight considered late? Recently on an HP flight PHX / BDL we pushed back 3 min early and sat in line for take off for 45 min departing 40 min late. The reason was that Delta had a 727 return to PHX because of a faulty cargo fire warning. This took one runway out of service and made for a mess. Does this count as a late flight as we arrived BDL 30 MIN late. If it does it is not fair and shouldnt count as a lite flight.

Yes, arriving 15 minutes or more past sceduled arrival counts as late, reguardless of reason, be it weather, mechanichal, crew, service failure or traffic. Most reasons for delays are beyond an airline's immediate control, life's not fair.

Just to clear up one more thing, you did not have a late departure. Departure times are off the gate. Time on the ground is irrelavant. In Boston we sometime sit 45-60 minutes but, that is not a late departure if the aircraft leaves the gate on time. They build some extra time into the block times to allow for this.
To answer the question you are most likely to ask, block times are based on averages for any given time of year plus some small fudge factor.
