France's relations with Libya had been strained after the bombing of a French UTA McDonnell Douglas DC-10-30 over Niger in 1989, which killed 170 people. Libya has since agreed to pay compensation.

Yes, they need to agree. They won't contradict the French Gov in that regard, but I can't imagine that this deal will be approved.

Anyway, I am sure the Germans will demand their share of the deal.

I should say "they won't publicly contradict the French Gov". Libya is not (yet) that type of country you sell highly-sophiticated weapon systems to. I guess they will sort it out under the table and this rumor might already be the last thing we hear from that story ...
