Does anybody out there know when the National Mediation Board will make up there mind in regards’ to changing the Unions elections procedures????

I am talking about how they elect a Union, right know the have the 50+1 in order to elect a union, know the NMB was debating in changing those rules.

I understand something will be published very soon in the Federal Register, with likely a public comment period before any changes (if any) are enacted.

Where are you getting this? The OP was talking about the representation elections to see if the DL people wanted a union or not.

It is my understanding (take it for what it's worth) that the NMB will issue their decision shortly; possibly as soon as the end of this month.

Besides the normal glacial pace of bureaucracy, the Xmas holidays, storms in DC, and the motion to have Pachula and Hoglander recused have all caused it to drag out longer.

AFAIK, the comment period is over and done with. If someone knows otherwise, please chime in- preferably with a link.

Not for nothing, but the last time I checked, the comments were running 10-to 1 in favor of the proposed rules.

At the risk of sounding condescending (not my intent) you do realize that this ruling will effect ALL elections going forward, and not just ours at DL, right?

Yes, So right know there in favor on changing the rules?? and if they do change the rules how will that work,,Right know you need 50+1 get get the Union in. How will these change work?????

Under the proposed rules change, only votes actually *cast* will count. As it is now, someone not voting at all counts as a "no."

If you're Pro union= Vote Yes.

If you're Anti union= Vote no.

Well my understanding from the labor department of a corporation is that they expect a proposed NMB rule change to get published, however there still will be time period for additional comment and adjustment before any potential final changes.

The political mood has changed in DC the last few months and several key members of Congress are now less enthused about seeing changes made by the NMB. Congressional legislation via proposed card-check concept is pretty much dead in this Congressional term, and there is worry that the political use of the NMB to push an agenda could come back to hurt its proponents and would also open the door for continued future flip-flop's as the White House changes between parties. Basically a Pandora’s box waiting.

I woul suggest you read the ballot and/or instructions that come with it. Partisan folks around you may try to mislead you.

The proposed rule change was published in the federal register on November 3rd 2009. That opened up the window for a 60 day comment period that ended on January 4th.

The NMB will now have a choice to either implement that change or retract it, once the final ruling is in the federal register it will become effective 30 days after it is published.

Expect legal challenges from the ATA.



The proposed change says:

If you want a union vote YES

If you don't want a union vote NO


The side that receives the most votes wins. Just like every other election in our democratic society.
