Lawyers: Bogus letters sent to governor asking to spare client's life

Saturday, February 11, 2006; Posted: 3:18 p.m. EST (20:18 GMT)

SAN FRANCISCO, California (AP) -- Lawyers for a death row inmate, including former Whitewater independent counsel Kenneth Starr, sent fake letters from jurors asking California's governor to spare the man's life, prosecutors said Friday.

Uhhhh, oops? His defense? That the jurors were intimidated when asked if they really sent the letters and thus denied it.

If this is true and Starr fabricated these letters, he should lose his license to practice law.

Yes, Kenneth Starr is opposed to the death penalty. He recently was on the defense team for Michael Morales and tried to get the judge to overturn the death penalty for him, thus resulting in this mess.

From the Sun Times article:

Friday, the San Joaquin district attorney's office sent Schwarzenegger new sworn statements from five of the jurors saying they not only still supported capital punishment for Morales, but had never spoken with the defense investigator who claimed to have secured their signatures.

Not Starr, not the other defense lawyer, but they investigator they hired.

Could Star and Co. been duped by their investigator.....I suspect it will turn out he is the villian.

But what would the invesitgator have for this? What motive would he have to fake letters? Starr has served on anti-death penalty cases before and he was on the defense team for this case, the same team who hired this investigator. Could they have instructed this guy to create these fake letters?

He could have very easily, and it is a possiblity that the investigator was told by them to do it.

But you also can't discount the possibility that the investigator didn't do the work he was hired to do, faked some letters that the defense team sent on.

In my mind at this point, both are equally possible.

Knock it off.

I would be saying the same thing, wait until the story comes out, I would be wondering if he was scammed by the investigator that was charged by him to seek out these letters.

But he is also the ships captain responsible for the actions of those in his employ.

Well my goodness, you can't expect a respected Special Instigator (oops! investigator) and Pepperdine Law School Dean to know every pesky detail of every little case he's working on.

if there were shenanigans afoot, well, it's not Starr's fault. It's not his co-attorney's fault. It's not the hired investigators' fault. It's the gosh-darned District Attorney, and his hench-peoples' fault!

I'd wait for the definitive word from Fox News before I made any snap judgements here.

Sorry, I don't see why the investigator would have any sort of motive to fake these letters. And even if he did fake them, Starr should have made sure they were valid. He is ultimately responsible because his defense team hired this guy.

SAN FRANCISCO (AP) - Former Whitewater independent counsel Kenneth Starr and a Los Angeles attorney said Monday they would withdraw unreliable affidavits from jurors submitted to Gov. Arnold Schwarzenegger as part of a bid to spare a murderer and rapist from execution.

The documents in support of clemency were purportedly made by six jurors interviewed by a defense team investigator. Prosecutors denounced them Friday as forgeries, but the defense team stood by them until Monday.

In a letter to Attorney General Bill Lockyer, Los Angeles attorney David Senior said he and Starr were "withdrawing any and all reliance on any exhibits generated" by one of their investigators.

Another statement taken purportedly taken from Morales' former Stockton roommate, and submitted to the California Supreme Court, requires "further investigation," Senior wrote.

In response, Keith Borjon, a state prosecutor, wrote California's justices that "I understand Mr. Senior's communication as a concession that forged and fabricated documents have, in fact, been presented to this court and to the governor's office."

It's a she, "Kathleen Culhane, the San Francisco private investigator who Starr and Senior said had interviewed the jurors, declined to comment." and why would Starr or Senior go back out and validate the letters? What would be the purpose in paying the investigator to get them originally then? That would be akin to the company commander going out and confirming what the reconnaissance patrol leader just told him.
