If it went the way CNN says, they should throw the book at him. And yes, firing multiple shots does smack more of attempted murder than attempted manslaughter, especially after the victim verbally declared himself cooperative and complied with explicit instructions.

I am guessing the DA didn't want to over charge the Deputy. Given the officer's longevity with the department and the fact that the shooting was duty-related, it could be the DA's belief that a jury would have a difficult time convicting an on duty police officer of attempted murder. I think the DA made the right decision. Also, if convicted, the officer is looking at a prison sentence of 18+ years. That's not exactly a slap on the wrist.
The person who filmed the incident has turned himself into Florida authorities to answer charges of aggravated assault with a firearm stemming from an incident in 1997 when he allegedly pointed a firearm at an elderly couple. He is currently out on bail and is awaiting trial in April.
