Ok so basically, what would you do in this situation? What is legal? Since he is beating the shit out of the car, could you run him over? Could you shoot him? Wow...

Seriously though, what would your options be? Mostly looking for ANCFlyer's insight on this... Because your life isn't really in danger, or is it? That would be just such a shit situation i cant imagine...

Run the asshole down...it's self defense...either run him down, or he starts reaching into one of those broken windows and starts injuring the occupants... One less idiot crackhead to worry about.

If I was armed, I would have shot him dead on the spot. If not, I would have made every attempt to run over him.
Right to protect your own property here in TX.
Besides, a crazy asshole swinging a weapon like that around me - I would consider that to be a threat to my life/safety, and that is also grounds for defensive action.

I'd probably attempt to run the asshole over! Failing that I'd just drive off quickly. People like that are not needed in society, they give nothing. A lot like Chavs. Shoot them.

He's got a deadly weapon. He's threatening people with it by destroying their property with them it in it. And there's no easy means of escape. Hmmm...running him down would be a coin toss whether it's justifiable self defense. A car (which itself is a deadly weapon) may not be considered on par with his weapon. It would make an interesting jury trial.

I guess if the car's driver is white and he runs over the black guy, his lawyers will make it look like an act of racism. Sad but true.

Without any hesitation.
I've always wanted to know what it feels like to run over someone.
That homeless is probably stupid enough to turn his back when he's done and that's when I'll pick up some speed and wham him. Oh yeah.

In all seriousness, I would literally just call the cops. In the US I wouldn't dare get out of the car but if I was somewhere more civilised I might just get out and try to mitigate the situation, as I am sure other observers would do.
By the way, that video was taken in Las Vegas. Look at the casino thing underneath the general store and if you look carefully you can make out the Stratosphere in the background. But that clip really reminded me of LA.
Incidentally - how would the owner of the car claim insurance damage for that? Surely he'd need eyewitnesses?

As a civilian, I can guarantee he would have been struck by my vehicle as I was trying to get away from him. As a police officer, he would have found himself bringing a metal pipe to a gun fight.
The driver of the vehicle did exactly the right thing. Stay in your vehicle and drive away. Bashed in cars can be repaired. Bashed in heads....maybe not.

I'd run the bastard over without thinking twice. He's breaking windows, smashing the car up, etc, and I see that as a threat to me - what if he tries to reach in through a window?

You want to "mitigate" the situation with an obviously crazy mf with a bat? Good luck.
Well you're right, I wouldn't actually. Perhaps what I meant to say is that if something was going on and it didn't look like I would sustain an injury and it was the sort of thing that other people were around for I would then try to mitigate.

Okay, most of you seem to be willing to run him down, but is it legal?
It can be considered self defense, I guess, but the thing is that when this guy is destroying you car you wont be able to run him over as he's too close to you to pick up enough speed to hurt him.
So what if he walks away and you follow him and run him over? I'd like to know what will happen in court after that.
BTW I have heard that homeless people in the US somehow have less "rights" then regular people, I have even heard that you can get away with killing one of them.

Quoting NWA742 (Reply 7): Right to protect your own property here in TX.
To protect your property from theft/arson/burglary
The use of lethal force in the face of vandalism is only permitted for criminal mischief at night... and then is very thin defense as the use of lethal force in the protection of property is only valid for unrecoverable losses.
It's the law in TX that your vehicle be ensured. The loss is recoverable.
Now, instead of saying it's a property loss issue, say that you were afraid for your life.
The law is mostly about learning how to properly articulate. Saying the right phrases at the right time can be the difference between not being charged and a life sentence.
reference Tx Penal Code Section 9.42 Deadly force to protect property.
Anywho, just drive off. And unlike the driver in this video, remember that the curb is an excellent escape option when traffic blocks the way. And no, don't worry about running over your assailant.
