No. America is the land of the publicity stunt, grab yourself some air time and get your picture in the paper lawsuit.

It only costs eighty bucks to file. If this guy came to me and wanted me to file it, I'd probably send him down the road but I'm something of a discriminating diner so to speak and I'm more interested in real stuff-on the other hand it might depend on how much I needed the dough and this one would be money down on the barrelhead, cash up front. And he doesn't even look like Mike.

Believe me, it won't make it past the first motion to dismiss. It's already served its purpose.

IMO, this guy is a moron and barely resembles MJ. Just another case of some schmuck trying to make a quick buck at the expense of others.

I still get a chuckle out of seeing tons of people swamp MJ's brother (who does look almost identical) at a Huntsville Stars game when the Birmingham Barons came to town thinking it was MJ just wandering through the stands before the game when in fact he was out on the field shagging fly balls very poorly.

Please. Loser pays is just a buzzword that the insurance industry is tossing around hoping individuals will latch on to as a good idea when it's just smoke and mirrors to make sure that defendants are deterred from filing legitimate lawsuits. At the end of the day, a complete loser pays system would put single defendents represented by single lawyers at a disadvantage compared to corporations defended by teams of lawyers. Don't get me wrong, this case is as idiotic as they come, but that's why you have pre-trial hearings and motions in order to weed out this type of stuff. Plus if Jordan and Nike both feel they've been harmed by this suit you have this little thing called a "countersuit" or file for a dismissal with prejudice. There are plenty of ways to protect defendants in suits from malicious/frivolous lawsuits that the insurance industry doesn't want you to know about.

Absolutely correct about 'loser pays'. It comes from the same house as 'tort reform'. There's nothing to stop anyone who is the victim of a meritless lawsuit from countersuing and getting attorney's fees. It happens all the time.

There was a guy last year who sued one of the broadcast companies alleging that some scene on Fear Factor really upset him, blah blah. Big splash. Since it was in the federal system I could follow it pretty closely on PACER. Turns out the guy was a professional pro se litigant and he got bounced real fast without leave to refile. His hobby was idiotic lawsuits.

It has little if anything to do with trial lawyers. The American Rule (yes, you supposed "ultra-patriots", that is what it is called) developed because Americans have always been wary of overreaching government regulation. Because of that, we developed a system where the regulation is done with market systems, namely money, especially since big companies can't go to jail.
