INVERNESS, Fla. - A convicted sex offender was sentenced Friday to death for kidnapping 9-year-old Jessica Lunsford, raping her and burying her alive in his yard.

His death sentence is subject to automatic appeals (as it is in almost all states). He will probably still try to get out of the death sentence by pleading insanity. Even then, on some of the other charges he is still sentenced to life without parole. Either way, it still a 'death' sentence, just a matter of a few years or many years from now.

I agree but our justice system has an appeals process. Part of the reason for this process is to combat the "Innocent person being executed" like you hear about here all the time here. He will see his day.

Another judge in the same Florida circuit just had to rule on whether or not the lethal injections are cruel and unusual punishment. I have to agree with what he said regarding the execution of somebody he sent to death row:

Our objective is to carry out a process that is consistent with evolving notions of the decency of man. It is not going to involve unnecessary lingering or wanton infliction of pain or lingering death.

I'm in favor of the death penalty, but we can't lower ourselves to the level of those who deserve execution....
