Tokyo police will likely soon send papers to prosecutors on renowned photographer Kishin Shinoyama and two female models over the shooting of nude pictures in public areas for a book, sources said.
Shinoyama allegedly took photos of the two models late at night in places in central Tokyo, including the Akasaka and Aoyama districts, between July and September 2008.
Shinoyama, 69, and the two women are suspected of indecent exposure...
The photos were taken for a 60-page book, titled "No Nude by Kishin 1 20XX Tokyo," published in January 2009. The models were photographed at cemeteries, wedding halls and on JR railway tracks, among other locations.

It's only illegal if it causes nuisance or offense to others. The photos were all taken at night so pretty hard for that to be the case. At any rate, it's stupid. There are clubs where couples can have live sex in front of others in major cities, there are bars where men can get coffee from women standing on mirrored floors in crotchless skirts, a quick google search will yield hundreds of exhibitionist websites of housewives and office ladies posing all over the countryside for their husbands or anyone who will pay - there's an entire blog network supporting such activity. Where are the arrests??

Unless things have changed drastically, it is not prosecuted as illegal. Japanese culture is to not see such things unless forced to confront them. It was quite common to have a car pull up and park at the beach. See young men and women step out and disrobe and put on their swimsuits. Families, old farts, etc. It was not nudity, it was just what someone needed to do and was "not seen".

I was in Moscow about 4 years ago with a Russian friend who works for the interior ministry,he is a crazy driver at the best of times, however when he drove me back to the airport the on the day I was leaving I think we were doing about 134/40 through the streets of the capital. He said that 99.9% of the time such things were possible in the USSR and if you do get caught all you do is reach for your wallet!!!

The big problem is that in Japan, the laws and enforcement are fairly arbitrary. That's upsets people and rouses cries of "hypocrisy". Pornography with public sex acts is actually quite common, yet you'll never see persecution of this. It's also not hard to come across sub-18 porn /soft-core porn being sold in the open. As long as it maintains a low profile, people look the other way.

Another thing we have to look at is that Japanese men are incredibly undersexed compared to the rest of the world. In how many other countries is it considered perfectly normal for a married couple to sleep in separate rooms?
