When I first saw the commercial during the Super Bowl I thought it was funny and never even came close to equating it to her.

These are the kinds of lawsuits that need to be thrown out before the even get to a courtroom.

I saw that commercial the other day. Lindsay Lohan didn't even cross my mind. Even when I saw the thread title and started reading the article, I had NO idea they were talking about that particular commercial.

Personally, I group this in the same category as Sarah Palin saying Family Guy slandered her.

Except this is even more egregious, due to a giant lawsuit.

Epic, I don't think Lindsay ever saw the commercial, she is a junky with a junk law suit. She should go to back to rehab to take care of her drug and addiction problem rather than sue for 100 million with an unethical lawyer. I guess this is to cover for her panned clothing line. I hope E-Trade continues running the commercial its funny and I hope the judge tosses the whole thing and Lindsay out.

Isn't it standard to file a Cease and Desist with a judge before a law suit ensues?

Anyway, this case will be dismissed at the complaint. Failure to state a claim for which relief may be granted. In other words, she hasn't been damaged, let alone anything worth asking $100 M to make her whole.

It probably will. The burden of proof is all on the Lohan camp, and the law is in E-Trade's favor. Even if the court found that the "lindsay" in particular was a direct reference to Lohan, and no one else (fat chance of that--how can she possibly prove that given that the only reference is a "milk a holic" line--is she saying that no one else named Lindsay has ever been an alcoholic?), there is also the whole public figure/satire/criticism aspect. Her name is well known in the tabloids for being a party girl and getting into all that stuff, so if she's suing E-Trade, then she should sue any other comedian or show that refers to her lifestyle.

It really is a shame. She was great in Mean Girls, and her career has just gone downhill from there.

Playing devil's advocate for a sec, my guess would be that the Milk-a-holic remark combined with the Lindsay name was what ruffled Lohan's feathers.

Had the E-Trade commercial aired w/either just the Lindsay name or just the Milk-a-holic remark; she probably wouldn't have filed suit. I've known at least a couple of girls named Lindsay, so it's not like it's an exclusive name.

My response (to her): Tough Tilly!

Somebody should send Ms. Lohan both the Cargo Bay and Attention Whore pics.

I think this case is a whole lot more idiotic. Family Guy directly made a joke about Sarah Palin's family...this commercial called a girl Lindsay. Lindsay, in America, is the 380th most popular name in America in 2008, and was all the way up at 169 in 1999. Sure, that may not sound huge, but there is also Lindsey which is 277th in 2008. All in all, still a popular name, even if it's fairly far down on the list.

The point being...taking a jab directly at Sarah Palin's kid is not the same as using a very popular American name in a commercial that just happens to be linked to a pathetic drunk of an "actress"

Granted I do not follow tabloids much if at all, but whenever I have seen her name mentioned in one, it is always as Lohan xyz or Lindsay Lohan xyz, and never simply "Lindsay". Plus, she does not have a unique name at all. According to the US Social Security Administration, Lindsay was the 46 most popular girls name in 1986 (the year she was born). Cher and Madonna do not even make the top 1000 of the last 30 years.
