OK, I can understand them targeting some of the US Navy auxiliaries that look like freighters. However, a frigate does not look like a freighter. And they opened fire first. What were they thinking?

I can't really see any pirate being dumb enough to fire on a warship; but a boat or dinghy from the ship? Maybe.
Also, if the warship returned fire, wouldn't they use weaponry that would completely blow the pirates out of the water? There are no reports of anybody being injured and the pirate vessel was only "disabled" before being boarded.
This sounds to me like a small boat action in the middle of the night. I bet anybody off-watch on the Nicholas didn't even have their sleep disturbed.

Reminds me of last year when pirates fired a few shots on the Peter the Great, the largest non-aircraft carrying warship in the world, that was returning to Russia after visits to Indian Ocean countries. Needless to say those 11 pirates were not turned over to anyone and are now serving sentances in a much colder place than they are used to.
