http://www.nydailynews.com/news/nati...dig_up_bodies_at_cemetery_on_.html

Quote:
The leaders of a tiny upstate town some 180 miles from Ground Zero are demanding that a Muslim group dig up and remove two bodies they buried on their land.

They say the group, a Sufi religious order, is maintaining an illegal cemetery in Sidney, N.Y., - pop. 5,993.

A spokesman for the Osmanli Naksibendi Hakkani order claims the town okayed the burial ground five years ago and is singling them out now simply because they're Muslims
Quote:
Town supervisor Bob McCarthy raised objections to their cemetery right around the time protests erupted in downtown Manhattan over plans to build an Islamic Center near Ground Zero, Hass said
Quote:
"Once again, I filed a burial permit and there were no objections," he said.

Then last month, the Sidney town board passed "an injunction prohibiting the burying of bodies on private property in violation of" state and town laws.

That injunction appears to fly in the face of the town zoning code, which permits graveyards on private property as long as they're in a contiguous 15 acre area.

Seriously can these bigots just give it a rest rather than give bullshit reasons to reverse a permit that they already issued? Do they have no respect for the dead?

And on another note, what is the point of terrorizing Sufis? They're like the Quakers of Islam and all the Muslim fundies don't consider them real Muslims.

But running an illegal cemetary is ok? And you of course know they are not and know for a complete certainty that the town is over run with bigots. Christ, if I illegally buried someone, Muslim or otherwise, a town being pissed would be the least of my worries.

Well, if they're actually dead it shouldn't be too much of a hassle...

It wasn't "illegal" 5 years ago when they approved it; is preferential when, as per the article, would also make other burial sites illegal in that town.

So you are for exhuming the bodies because the town had a change of heart and decided that the permits they gave out are no longer valid?

There should be a record of an approval for something as unusual as burial on private land. I would assume the owners of the private land were smart enough to have documentation of the approval in their records. If not, well there is a problem. The burden of proof then falls on them. We all know, the government is never at fault, never is here anyway.

Except it isn't illegal. At least, until they passed an injunction years after the burial.

According to the article, the cemetery was approved by the town, and the injunction the town passed violates their own code.

Can't wait for Paladino to make this an election issue.

the towns next move will be to declare all archaeological sites with ancient remains illegal... it's just a PR stunt and will blow over.

Absolutely disgusting. What's even crazier is that we almost look like we are singling out Sufis, given that the ICC 2-3 blocks from the WTC is also being built by a Sufi.

Gotta love when our "great allies" in Saudi Arabia are Wahabis and we are attacking Sufis in our own country where we are supposed to have absolute religious freedom and a secular government. How screwed up is that?

There is nothing illegal about it.

It's not illegal when the town has already approved the land's use as a cemetery.

And I wonder, what is your legal expertise on NYS cemeteries?

Quoting StuckInCA (Reply 6):
Except it isn't illegal.

I'm not so sure, it seems that its not actually registered as a cemetery just that they have some sort of "legal document" saying they can bury there, which is not how it works in NYS. The land has to be designated as a cemetery and approved by the NYS Division of Cemeteries, or if a private, or religious burial land, must be designated as such and is still subject to regulation.

Quoting OA412 (Reply 12):
It's not illegal when the town has already approved the land's use as a cemetery.

The article is pretty vague on whether it was approved or not.

Really? Because I'm seeing this passage:

Confronted with a December 2005 letter to the group from the town's code enforcement officer stating that "a cemetery at this location would be an allowed use," McCarthy [a town supervisor] said, "I'm not a lawyer."

And this one (emphasis mine):

The Sufis bought the 50-acre sheep farm in 2002 and set aside 650 square feet to be used as a cemetery. It wasn't until November 2009 that it got its first guest.

"It was a brother of ours who died in a car accident in New Jersey," Hass said. "I filed a burial permit with the town and everything was okay."

Over the summer, a second man was buried there - a Long Islander who died of stomach cancer, Hass said.

Also, there are no state regulations concerning burial on private property, according to the state's Division of Cemeteries.

That's not very vague - it sure sounds like it was approved.

Quoting Cadet57 (Reply 13):

Incorrect. Not only does the article contradict that statement, but so does the website of the NYS Division of Cemeteries:

I have mixed feelings about burying people on private property (when you sell it, what happens ?) but that clearly looks like some (christian) bigot had nothing better to do than this, once again making his religion look bad. I would not be surprised if the same guy wouldn't want a muslim plot in the town cemetery.
