To make it worse she threw it in the trash disposal so no reattachement like Bobbitt. Poor guy. Once he ate that meal he was done for.

She told officers "He deserved it" Hmmmmm That can be argued I think!

I know she wasn't but the defense mounted a good case and the jury bought it lock stock and smoking penis.

I wonder if you could be executed for unlawful penis removal, in this new case it was pretty cold blooded, he could have died, so she should pay the ultimate consequences IMO.

I sincerely hope that was tongue-in-cheek. While cutting off someone's penis is a very serious offence, it is nothing close to attempted murder. Capital punishment (in Western countries that still use capital punishment, such as the US) is reserved for the most serious of crimes, such as first-degree murder - not for aggravated assault.

Of course, if this had taken place in Iran or Saudi Arabia, she might face a much more severe punishment than imprisonment.

It's not really... attempted murder, like all crimes, has two components: the actual physical act and the mental intention. The state would have to show that this woman had the specific intention of killing her husband, (or harming him to the point where death is probable) to meet the definition of attempted murder. The very nature of inchoate offences makes the intention of the assailant crucial for a charge to stick.

I really doubt this circumstance fits the definition of attempted murder, and the DA is not going to charge her with that. The charge that is most likely is assault with a weapon (or whatever is analogous in that state).

Everytime I read this story it makes me cringe, what disgusting thing to do! No lie, what annoys me more is that some people think it's funny or is making lighthearted jokes. Honestly, I think losing my manhood would be worst than losing my life, yea I said it, I would rather be dead. If I was that guy then that lady would have to hide in the darkest of places because she would regret it. Sucks though because since she's a woman, then she'll get 6 months in a "facility" ( not even prison) where she'll get to talk about her feelings then she will probably get let out early for good behavior And put on probation!

Nope, not unless the cutter intended the victim to die. The crime of attempt is when the defendant does not fully carry out the ultimate intended crime but comes within "dangerous proximity" of doing so, and also has the specific intent and actual intent to do so.

So attempted murder would mean that she 1) came close to doing something that would kill the victim and 2) wanted the victim to die. Tough to sell here, since I think she only wanted to torture him...which in California is a crime in and of itself.

California has a crime called Mayhem, removing someone's body parts. Aggravated Mayhem might fit here:
"A person is guilty of aggravated mayhem when he or she

intentionally causes permanent disability or disfigurement of another
human being or deprives a human being of a limb, organ, or member of

Plus there might be enhancements because she drugged him and tied him up (False Imprisonment) in order to do this.

It's interesting that California has a specific provision relating to dismemberment, I wonder if this is a more common occurrence than I first thought. Other jurisdictions have a more general category where something like this could slot under.

There are very important blood vessels near the penis. Both arteries and veins. I don´t know where the cut was made but he could have easily bled to death. I don't know if such a charge exists under California law... but in my mind, the idea of attempts and manslaughter are difficult to reconcile. The defendant could not really plan and execute steps to "manslaughter" her husband, to do so would simply be attempted homicide...

No, you're right, it isn't. And I don't know about CA, but here in TX such a thing could easily fall into a category of reckless aggravated assault (I may have the wording wrong) with intent to maim. It would carry an identical penalty to attempted homicide.

We have to consider what a penis actually does. When you have an erection, all that "stiffness" is essentially brought about by what amounts to hydraulic pressure. In a human, the only source of that (in any meaningful amount) would be blood pressure. So, it stands to reason that a severed penis could turn into a very easily lethal situation WRT blood loss... Yes, I could see how that would actually kill someone if left untreated.

No kidding. This is a serious mutilation. Would anyone be laughing if this was a set female breasts removed... or ANY part of a child? If guilty, she would need to serve the same penalty as though if it were either of the aforementioned examples.




On a side note, anyone think of that "Mein Teil" song when this broke? That was some seriously whacked out stuff, IIRC...
