Actor Tommy Chong was sentenced this morning in federal court to nine months in prison and fined $20,000 for distributing thousands of marijuana bongs and pipes online through his California company, Nice Dreams.

Chong asked U.S. District Judge Arthur J. Schwab for community service, saying he is not the dope-addled character he portrays in the movies and is dedicated to helping young people stay off drugs.

That position, however, belied his comments after his guilty plea in May, when he joked to the media that he might put his criminal case in his next movie with long-time partner, Cheech Marin.

The U.S. attorney's office said Chong, 65, had used his celebrity status to promote marijuana use and his business, making personal appearances at head shops throughout the United States.

Schwab denied the request for community service or a term in a halfway house and said the prison term was the appropriate sentence.

The sentencing range called for a term of six months to a year in custody and a fine of up to $250,000.

Chong will be allowed to self-report to prison.

9 months in federal prison for selling bongs? Give me a break!
Hey Europe! Feel free to give us in the US abuse about this one. I'd completely agree with you on this one!

Hey, you have to send the right message out somehow! Glad his celebrity status didn't work to protect him.

By the way, I do love his character, but it should be kept as that, just a character. Just like Ed O'Neil isn't really like Al Bundy, and Carroll O'Conner wasn't really like Archie Bunker, Tommy Chong should have kept his character on film only.

Well if he was selling dope, yes. 9 months is fair.
Bongs? Ridiculous.

Note that I never take drugs and generally dislike those who do, so my opinion is not at all based on "involvement" in the area.

There has to be more to it than just selling the bongs. It's like a variety store selling matches to a minor and getting the same punishment as selling cigarettes.

So 9 months for selling weed is okay, but not for selling bongs and pipes, things used to smoke the weed? So selling it is wrong, but encouraging its use by the sale of paraphenalia is okay? How does that work?

Because it in and of itself is not dangerous. The drugs are. (Subject to argument in the case of pot, but that is another issue altogether.)

As some of my high school and college would tell you, you can make a bong/pipe out of just about anything. I've personally seen someone smoking it in a apple. Should we ban them too?

Edit:
Actually, the Google search also yielded this amusing little bit, check it out.

Why am I now reminded of the "Let's Make A Dope Deal" sketch?

The only way I could see him violating any laws is if he didn't market them as "water pipes" or as "tobacco pipes", which is how every head shop in the US marketed bongs as. You go into one of those shops and say the word "bong", you're out on you butt in no time flat.

Pipes and bongs are sold 'with the intent that they will be used for tobacco' its up to the buyer to determine what to put in it.

Does he have a website by any chance? Maybe his bongs will go up in value and start showing up on ebay as collector's items!  Big grin

I bought one of his bongs last year. They are of extreme high quality and very smooth to smoke. My roommate ended buying one for himself after using mine. It's too bad that he was forced out of business by a dumbass war on drugs that will never be won. Police and other officials who think they are winning when they do things like this are about as ignorant as they get.

I agree the war on drugs will never be won completely, but law enforcement can't just sit back and let people do whatever they please if it's against the law. Whether you agree with me or not, drugs are a problem in society, so this is a step in the right direction. I know that many great and responsible people do drugs, and I know pot isn't a hardcore drug. I still don't agree with it, and if it is illegal, then there are ramifications that those breaking the law must deal with.

Maybe when he gets out, he'll set up shop here in Canada.  Big grin

If they're going to bust Tommy Chong for selling bongs over the Internet, then they need to bust every single gas station and convenience store in America for selling rolling papers - Its the same difference! This was a bullshit conviction and one just for show.
