This afternoon, an attorney representing the Kerry/Edwards presidential campaign filed two important motions to preserve and augment evidence of alleged election fraud in the November election. The motions were filed in the matter titled Yost et al. v. Delaware County Board of Elections and J. Kenneth Blackwell (Civil Action No. C2-04-1139) with the U.S. District Court for the Southern District of Ohio. The document is titled "Motion Of Intervenor-Defendant Kerry-Edwards 2004, Inc. For A Preservation Order And For A Leave To Take Limited Expedited Discovery."

The purpose of the motions is twofold: A) To preserve all ballots and voting machines pertaining to the Yost matter for investigation and analysis; and B) To make available for sworn deposition testimony a technician for Traid Systems, the company that produced and maintained many of the voting machines used in the Ohio election. The technician has been accused of tampering with the recount process in Hocking County, Ohio, though other counties are believed to have also been involved. Any officers of Triad Systems who have information pertaining to said tampering are likewise subject to subpoena for sworn deposition testimony.

If the judge in this case allows these motions, and these individuals are served with subpoenas for deposition, the information disclosed under oath could have a major effect on the case. Likewise, judicial approval of these motions will open the door to forensic analysis of both the ballots cast and the machines they were counted on. If tampering took place, such an analysis could reveal it.

Bush won well outside the Margin of Litigation/Theft (unlike the governor's race in Washington which the Democrats are trying to steal) and since the electors have already voted, there is nothing that can be done to change it. When the Congress convenes on January 6th and reads the votes, it will be final that President Bush won a second term but nothing can be done to change it now. Until then, all the Democrats can do is cry and spin conspiracy theories.

Your candidate lost, President Bush won, get over it or go off the deep end and turn off even more Americans. Screaming about a stolen election in 2000 really helped you in 2002 and 2004 didn't it? Maybe you should try to figure out why your party keeps losing elections instead of trying to shift blame to everyone else. If you want some advice, try listening to Senator Zell Miller. He figured out long ago why the modern Democrat party turns off the majority of Americans.

About the Washington Gov race...........It is and has been the Reps that have been trying to steal it.......Rossi said if the second re-count favored Gregiour he would conced, he has not yet because he is a sore loser......the process has worked it is time to let Gregiour have her earned GLORY.

An observation..........we never had election at least not two in a row that had the essence of theft.....not until PNAC and George Jr came to town.

There will be a Senator this time around who will protest on Jan 6th.....this is not over and wont be until the processs is fixed.

You hit the nail squarely on the head bro. Couldn't have said it better myself. I think that's the REAL reason Kerry lost. I don't think this "Moral Values" platform is as solid as everyone would like us to think it is.

I think it all boiled down to a backlash against the perpetually whining Democrats. The best they could come up with was an "Anybody But Bush" campaign with a candidate who not only failed to provide a coherent and viable alternative, but couldn't make up his mind about anything either.

At least with Bush, even if you hate him, you know where he stands.

I think sticking to what you believe in rather than having fluid stances, that waver depending on who your audience is and what the latest polls say are what make a leader. Not someone who's good at chumming up and sucking ass to whoever happens to be present.

Isn't this hand recount the THIRD recount, though? I thought I'd read the initial count was followed by two recounts, and the hand one was the third.

And seriously - must the votes in close elections be recounted time and again until the Democrats like the outcome?  Big grin

The SECOND re-count? You mean the first one didn't suffice? Do you think the Dems would require a third or fourth?

For those not in the know, Kerry kicked in $250,000 to help the Dems. fund the hand recount. They needed a total of $750,000. Now that this hand recount has changed the outcome, guess what? The Dems. (and Kerry) get their money back, and the cost goes WAY up to cover the cost of the hand recount, and guess who pays? Yep...the taxpayers of Washington state, who else?  Insane

Now...we've had the main election, Rossi won by 261 votes. Then we had the machine recount, and Rossi WON AGAIN, this time with a margin of like 42 votes. Then the Dems. started crying, and funded the hand recount...where...guess what...drum roll, please....723 ballots somehow magically appeared in King County (the largest county by population) and not surprisingly, the Democratic-controlled state government ordered them included, too. And, Gregoire is now ahead.

This is ridiculous. King County has made a mockery of the election process, and we'll never know who won. Gregoire the Democrat will be sworn in, because the Dems. always win high offices here. It's just the way it is. But, remember that a lot of Dems. this time crossed party lines and voted for Rossi, and Gregoire, barring a miracle in her 1st term, will have a huge fight to win reelection in 2008.

The FIRST re-count was an automatic re-count under the LAW. The Democrats had NOTHING to do with that.

The second re-count was by the Democrats who knew what the outcome would be. When the Republicans don't get they're way, amazing things happen. Votes appear!! *Gasp* And the Democrat won!! Holey crap!!! Those votes that the republicans had thrown out came back to bite them in the ass! Big suprise!!!

Stop your stupid crap about Democrats always whining for re-counts. You guys really have no clue. This is why republicans infuriate me.

A circus was created in Washington, and these missing votes sound like reason enough to perhaps start all over again.

It's interesting though how you assume the Repubs had simply tossed them out like it was some vast conspiracy...typical of a sheep. We see it all the time here on these boards...and it doesn't matter if it's dem or rep...the method of operation is the same...smear the other and portray your preferred side as the victim/hero.

That's just something partisan folks like you just love doing...and in the process you alienate the American public...this is why people like you and B757300 infuriate me.

As for Kerry's motion, it's his right to do so. It probably won't change the final result, but such motions are necessary at least to point out the widespread glitches in our voting systems. These are issues that still need addressing, even this long after the Florida debacle.

Sniveling? How little you know of me. I'll have you know I voted Libertarian in this election...I knew the candidate wouldn't win, but I would never have my vote counted for the Shrub or Kerry. Never would I allow my vote to go to two political terrorists who use fear tactics and smear campaigns to distort the truth for their own good.

No ANC, what I'm calling for is some maturity (there is such a thing as a bad winner), and a full check out of our voting system to prevent glitches and patch up an potential fraud-inviting holes. It's just that simple.
