Stupid Kid With An Xbox 360 Gets Dad Fired

A kid on the gamespot forums was bragging to members about how he has an Xbox 360 because his stepdad works for Microsoft. Of course, the members jumped on him like nothing else. In the end it turns out that he was right, and to prove it he took pictures of the console and posted them on the internet:

so now it looks like the smart-ass violated Microsoft's NDA (Non-Disclosure Agreement) and will cost his stepdad a job at Microsoft. Anyone want to guess what's going through that dad's mind?

NO!!!

That's an EXTREMELY unenviable position to be in.

The only points of interest are A) If the father signed the NDA, does it have a clause about how to treat family members (IE don't even share with them)? If so, fry/Fu¢k him(the dad) for letting the little shit have access to it. B) If the NDA states that he can have the game and share it with his family, and the son never signed the NDA, then it's time to get a lawyer and fight for AT least his job back!!!

Phew...lots of replies about this. But it seems it's a fake. Pointers: 1. no ligths on the console, most likely a dummy. 2. cables seem to go straight under the pillow (hiding an XBOX maybe?), then come back out at a strange angle. 3. White cable in the back of the TV could come from a VCR just showing the XBOX 360 demo.

I've done beta testing for a few different companies, and depending on the company, the NDA may or may not include direct family. I know when I did testing for 3Com hardware, if you said shit to anyone, your off the beta, period. Same goes with some MS software(Longhorn), while some are less constricting (MSN Beta). I have been tempted numerous times to break my NDAs, but so far so good. Heres an example of one of my NDA's:

a) This AGREEMENT shall be COMPLETELY in effect from the date written above, and will REMAIN in effect until otherwise, unless notified by either party to the other giving 30 days notice IN WRITING. b) If the BETA TESTER chooses to leave or is asked to leave for any reason, this AGREEMENT remains valid under all circumstances pertaining to all software and all trade secrets.

7. Clauses 1b, 2, 3, and 4 shall survive termination of this AGREEMENT for whatever reason.
8. This AGREEMENT shall be governed by and shall be construed, interpreted and enforced in accordance with the laws of the United States of America, and the State of Wisconsin. Furthermore, the parties acknowledge and agree that proper venue and jurisdiction shall lie in appropriate courts in the United States of America, and the State of xxx, in the City of xxx, if the need should ever arise.

I asked someone who works at Microsoft about this and here's what he said.

1. It does seem to be a real XBox 360.
2. The dad appears to work in a Northern California location, not Redmond as was discussed in the thread.
3. Unless the kid revealed something that had not yet been disclosed, the dad wouldn't get fired. The example I was given is as follows: If MS had not announced that the XBox 360 had backward compatability, and the kid posted a photo of him playing Halo 2, this would be an issue. Or if the kid had posted a photo of Halo 3.
4. My contact had never heard of the dad's supposed job title.

So final conclusion: It probably is a real XBox 360, and the dad probably won't get fired.
