To keep this discussion going, I will throw in my $0.02 now.
I don't believe that Wen Ho Lee is guilty of espionage or any of the other charges brought against him. In fact, others who have violated the policy of downloading sensitive nuclear data to unsecure computers and tapes, whereas Lee was fired and then incarcerated in a maximum security prison with some of the worst offenders of society. Lee is shackled whenever he leaves his cell and access to fruit and a certain number of publications have become privileges. His ankles remain bound when he visits his lawyer in prison.
According to two former counterintelligence agents, Lee was singled out because of his race and the fact that he is ethnic Chinese. An FBI agent admitted to lying at a court hearing before Lee was sent to prison, about a polygraph test that Lee took, which he in fact did very well on. There have also been reports of incidents of discrimination against people of ethnic Chinese origin at the nuclear lab. Lee has been a naturalized U.S. citizen from Taiwan for over forty years and his wife worked as a CIA informant.
Being an ethnic Asian myself, I am disturbed by this case and how Wen Ho Lee could spend the rest of his life behind bars. I am also disturbed by the harsh treatment he has received in prison and all of the negative publicity he has received. I am hoping for an end to this sooner or later and the implementation of reforms to prevent cases like this from taking place again.
