This Can't Be Legal

Tue Feb 04, 2003 8:14 am

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=3205354842&category=13904

Ok this guy is selling printed photos of the crew members of Columbia from his computer (a Nasa photo btw) and selling them. Obviously he didn't take the photo or he probably would have used a more professional way of printing them. Is there a link on ebay where you can notify them of stuff like this?

And he wants 20 bucks for it  Smile/happy/getting dizzy . I could print the photo myself (from internet) for much cheaper price if I wanted to, I can't imagine someone would buy the picture...

it's not illegal, but if NASA pursues it they could force eBay to either close the auction or force the man to pay NASA a royalty as the picture doesn't belong to him and its not his to sell.

Frankly, I think NASA has much larger things to deal with right now and if they are concerned about this guy, they aren't doing their job.

as for the auction, well it's free market capitalism. if someone thinks the seller is adding $20 worth of value to a free picture and wants it, then here you go.

Thats why eBay is quite possibly the coolest invention since sliced rye break.

Twaneedsnohelp, this is true, but I think it's something like with that guy who sold his soul on e-bay  Smile. E-bay did forbidden him to do any such deals in the future after all though.

Did did you stop to think...even in the smallest moment...that maybe NASA has a bit more to worry about than copyright infringement?

This gets the petty post of the year award!

Just an update I have informed EBay's SafeHarbor (Their fraud unit) of this item and they are now investigating this auction

I'm with you on that one greg. But if Ihad.. has the time and the will to pursue this guy, good for him. I say let him sell the photo. He has a willing buyer, he'll advertised the product accurately.

Auction was created on Feb 1. If this is what the guy first thinks of on the day of a national tragedy, he's got to be a schmuck.

No Greg, the disaster completely slipped my mind!  Pissed

IHadAPheo, thanks for letting them know. Can you give me a link for future refrence? He shouldn't be allowed to sell them on ebay. TNNH, so he steals one of my photos off here and trys to sell it, are you saying that's legal?

May not be illegal, but you could always express your feelings directly to this guy by clicking on the "ask seller a question" link.

I received a couple of emails from Ebay on this one a "canned" response saying "thanks for your report...) and another saying I was not the only one to complain. So if anyone else wants to chime I have posted the link for EBay complaints below (they sure do make it hard to find).

If he obtained the picture at some kind of event before the launch, he should have every right to sell it. It might be in bad taste but bad taste isn't illegal.

Not to rant on here but..

If he obtained the photo legally he may sell IT, it does not give him Carte Blanche (sp?) to reproduce it and sell the reproductions for his own profit.

If he makes any money off the photo, your entitled to a piece. if he refuses, take him to court. your not attempting to rebuild a space shuttle destroyed at 13,000 mph, so you can fight the good fight. NASA should have other priorities.

Well... it appears he hooked one sucker on his $20.00 fishing trip. Some people are just so stupid.

If I wanted a picture of the crew of the Columbia, I would print out that picture (which is easily found on any news website) on any one of Purdue's color laser printers. This would cost me the low price of... FREE! (If you want to nit-pick, I do pay $500 out of my tuition for computer lab fees.)

Just for those of you who aren´t that familiar with eBay: the seller´s asking price was 1 cent; it´s now at 20$ because six people placed 10 bids on it, driving it up to the current level.

If anyone tried that, I'd automatically nail them to the wall because that is copyright infringment. I never even said anything about the disaster (for obvious reasons), I know NASA has other things to worry about right now. That's why I stated where on ebay can you report this. Thanks to everyone who responded without a smart@ss remark.

Twaneedshelp, why is it OK to sell copyrighted work if that work belongs to NASA?
Is it also OK if I find a photo you took on the net and sold that?

NASA pictures are not usually copyrighted. If the original picture is not copyrighted then people can do as they wish.

However, you cannot have any respect for people who make money from disaster. But you cannot blame him alone, what about the people who bid?

Profiteering off of tragedy is the American Way. It may be egregious, but it's still the American way.

How are Ambulance companies, burglar alarm companies, auto repair shops, and so on operating?

If there was no crime, death or disaster, then there would be little reason for these businesses to exist (except maybe for the man who has a heart attack while watching The Golf Channel)

And let's be honest folks. You know as well as I do that if you had some obscure piece of whatever laying around that could suddenly net you an extra [tax free] ten or twenty thousand dollars, and you'd never miss the item, you too would jump on that bandwagon.

So don't even try and give that cock-n-bull High Moral Ground BS.

You're just jealous.

Another update, the auction closed because the seller "pulled" the item. I guess a couple of complaints to Ebay's safeharbor did the trick, and saved some poor schmuck from being suckered out of $20.00.

ADG: That picture is property of NASA whether its copyrighted or not. For anyone to profit of it, they must have NASA's consent.

Jwenting: Depends on what your definition of "ok" is.
