Drivers Spot X-Rated Films in Other Cars

DETROIT - Andrea Carlton hadn't planned on telling her daughter about the birds and bees until she was 8 or 9. But that changed the night 4-year-old Catherine spotted a porno movie flickering on a screen in a minivan nearby.

"Just like there's no windows in a strip club, you shouldn't be able to see inside windows in a car when they're watching X-rated movies," said Carlton, a 26-year-old from Gurnee, Ill.


More and more Americans are buying vehicles with DVD players, usually to keep the kids entertained. But an increasing number of other people on the road are catching a glimpse through the windows of more than just "Finding Nemo" and "SpongeBob SquarePants."


Depending on where they are driving or parked, motorists could face fines and even jail time for screening X-rated stuff. But where the law may not be clear, some are calling for tighter regulation.


"Residents should not be subjected to those obscenities," said Flint City Councilwoman Carolyn Sims, who is examining whether an ordinance packing a $500 fine is needed. "They do have a right to have peace and tranquility and not to have this exposure to sex in their face."


A driver in Schenectady, N.Y., was arrested last month after rolling past police with a DVD titled "Chocolate Foam" playing on the passenger-side sun visor in his Mercedes-Benz, authorities said. The movie also was rolling on screens set into the car's headrests.


The driver was accused of breaking state laws prohibiting watching TV while driving, as well as another law making it illegal to exhibit sexually explicit material in a public place.


"The detective had a clear view of what was playing through the window. Anyone walking by on the street could have seen it," Schenectady police Lt. Peter Frisoni Jr. said of the nighttime traffic stop. "If he had dark, tinted windows where you couldn't see in, that wouldn't be a public display."


As for Carlton, she was driving in the Chicago suburb of Buffalo Grove with her daughter when Catherine glimpsed the sexually explicit movie. The experience last fall upset the girl and angered Carlton.


Carlton and her husband sat down with Catherine and offered the best explanation they could. Since then, Carlton has spotted other motorists with explicit movies playing, including a couple watching from the back seat of their car in a store parking lot.


"You're not allowed to have sex in your car, so why are you allowed to watch it?" Carlton asked.


Most states, including Michigan, have laws that make it illegal to watch TV while driving. Laws governing the exhibition of pornography vary by state, but experts say they could be applied to drivers as well.


"I think those restrictions would apply if the content is located in a vehicle," said Jeff Matsuura, director of the law and technology program at the University of Dayton. "You have effectively moved beyond the privacy of your own home."


During the day, it is often difficult to see what is playing inside another vehicle. But at night, the screens are easily visible from a passing car or a vehicle stopped alongside at a traffic light. The screens are also getting bigger.


In Flint, Sims took up the issue after hearing from a woman who was driving with her 5-year-old when she spotted porn playing on a vehicle's 13-inch TV screen. A police officer who happened to see the display pulled over the driver, Sims said, but let him off with a warning.


To Sims, a 23-year police veteran who retired in 2001, playing an explicit movie in view of other motorists or pedestrians is akin to flashing or having sex in a public place.


But Michigan State Police, who have not had any cases of in-car porn, say playing an X-rated movie might not be easy to prosecute unless it can be proved that the motorist intended for others to see it.

Why is it that only mothers get to bitch and have laws passed banning for freedoms?
Shouldn't there be a law passed against nosy people lookingin to other peoples cars?

I don't know, Larry, but this country is getting more and more ridiculous. Just because of that, I want to buy a big ass van with some huge TV screens, drive around and corrupt children's minds everywhere  Smile/happy/getting dizzy.

I thought I'd never see myself defending those SUV drivers with DVD players in there obnoxious vehicles.
This just gives the government more power to infringe on our individual rights.
No police has the power to judge what those watch on TV in there mini-vans/SUVs.

Look, I'm about as libertarian as they come when it comes to personal freedoms, but this is pretty clear-cut:

People can just mind their own business and don't look into other peoples cars. Thats private property. It would be the same as if people kept staring into your window in the livingroom. Porn will probably soon be illegal to watch in the livingroom because someone from the street can see right in to te livingroom.

Im not stupid enough to do it witout curtains. I live in an appartment on 3rd floor. So I dont care. But I was thinkin more about those people who does watch porn in their livingroom.

I remember having sex with my ex on the beach between these huge rocks near the Golden Gate Bridge. I swear no one could see us.
When we finished, we heard this roar up on the hilltop of about a half dozen guys cheering at us, whistling and clapping their hands. I just took a bow and my girlfriend was laughing in embarrassment.

I am sure all who saw managed to still get good grades in school and find decent jobs.
Hell they probably even learned something to enhance there relationships.  Smile

Well, it's kind of pathetic if you need porn while your driving your car, but nonetheless, what could follow? Would someone be offended if they saw a Playboy mag. on your front seat? How about if the song your listening to has vulgar lyrics? What if they didn't like your Pro Choice or Anti Abortion bumper sticker?
I've seen Mini-Vans and Suv's with movies playing in them as I've driven along side them. The screens are so small, I could never tell if it was porn or Disney...seems like you'd really have to get close and stare to figure out what is playing. Now there's a privacy invasion.

This kind of deal will probably have a local law written, but will probably also boil down to case-by-case scenarios. I imagine there are occassional complaints filed against neighbors having sex in plain view of casual passersby when the curtains open in their own homes, and conversely, there are anti "peeping Tom" laws. Same so with porn movies in "public view".

As far as vulgar lyrics music in a car, many communities have (or should have)a nusance decible law that should take care of that.

In any event, the importance of such cases will probably be more signifiant to the padding of lawyer's pocketbooks more than a freedom threat. Regards...Jack

I'm rather shocked at the selfish attitudes here. I'm no prude, but I think that people should be required to show a minimum of common decency in their lives, and that includes not showing porno movies in full view of any child who happens to be looking out of his window.

You say that this is a further reduction of freedom. Well, how about the freedom of others to raise their child the way they want to? Do you think that people should be allowed to walk naked down a public street (make he/she really fat and ugly)? How about laws against theft, rape, assault and murder, aren't they restrictions on freedom too?

The Social Contract of Democracy is where people are willing to sacrifice some of their freedoms for the common good. Total freedom for all also has names - anarchy and chaos being among them.

Well, how about the freedom of others to raise their child the way they want to?

I agree with that as well. Raise you child to mind there own business and that peeking in to other people's private property can get them in to lots of trouble.

Oh my god. I'm agreeing with Superfly over CFalk! Nooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooooo. Anyway. Lol. People SHOULD be proscecuted if they have porn playing in the front seat where the driver can watch it. But, if people want to watch porn in the backseat, go right ahead. Most back windows are tinted anyway. Your car is your private property. You paid for it, or are leasing it, and you can do what you want inside it.

Have you ever been stuck behind a van with one of those TVs? It's impossible to not look in. The only way to ignore it would be to put your head down, thus making it impossible to drive. Those TVs are also very distracting. I was driving down the highway next to a car with one and the flickering in my periferal vision was really annoying. (Let alone Pornos kids watching porn.)

By the way, your car is not your house. If I have the same rights in my car as I do in my house, then why can't I have sex in my car in the middle of traffic? It's okay in the privacy of my home, but not in my car- and for obvious reasons. This whole deal is the same way. Put a curtain in your car (just like a house), then I won't care.

I was working cashier in drive thru one day about six months ago and a woman, very causual about the whole thing, has a porn going in her DVD player, and she was on the phone! Just like this is an every day thing. Besides that, the only time I have ever seen a TV screen in a van or car is at night: A soccer mom and group of kids were going into Portland watching Finding Nemo.

How about instead of banning porns in cars we ban TVs in cars? That should be more the issue. But no. Soccer moms think they still rule.

That is a very weak argument. The DVD/Video players are for the passengers. If the guys are out for the evening, they have every right to pop in a video of there choice. You can't have penetration sex while driving. My girlfriends have given me b/js and hand jobs while I was driving many times and I still have a clean driving record and I certainly didn't poison the minds of little kids.

1. Driving is a privilege, not a "right." Hence...

2. ...reasonable restrictions may be placed on the licensure of persons to exercise that privilege.

It is difficult to conceive of the circumstance where explicit porn on a clearly-visible screen would not be distracting to those in the immediate vicinity, whether the distraction be in the form of the driver reacting to the show, or reacting to children having seen the program.

Setting a readily-determinable standard may be a challenge. But the fact that establishing a standard is tough is no excuse for not making the effort to do so.

BTW, how many of you who find nothing objectionable about clearly-visible porn, have small children of your own? Things like this were a lot easier for me to find amusing before I found myself having to devise reasonable explanations for my son, or my niece. Not so irrelevant anymore.

I have two nieces and I see the changes my sister and her husband deal with that all parents deal with. Part of being a parent is teaching your children to respect other respect peoples private property. One doesn't need a parent to understand this.


I don't even like the demographic that would watch porn in an SUV anyway. Everyone here know my opinoins on luxury SUVs and the idiots who drive them.  Smile

I can certainly agree with that. However, conversion vans and motorhomes have been coming with TVs for years. Thing is, it's hard to see the TV of those outside.


I think this is another opportunity for politicians to come out and pound there chest and look like they are doing something good. Crying with the soccer moms will almost gaurantee your re-election. What politician would come out against a law like this anyway?
It may have good intentions but really just hands more power to the government/police to have a reason to pry in to our personal lives.
If someone were watching these porns in a SUV parked by itself in a park at midnight, a cop can still cite this person even though it's after curfew and not a child in sight.

And I am agreeing with Calk on this one. Will wonders never cease? Children look in other cars, that's a pure given fact, and displaying pornography where children can see it is illegal.

Larry, how in the hell do you expect to drive around town without looking through other people's windows? Do you seriously think that we should be training our kids to not look out of the windows and just stare at the floor? Unless the owner does something to alter the condition, like tinted windows, your car is essentially a place in full public view, and you should behave the same way as you would have to, say, on your front porch.

Absolutely. Or at least putting in some kind of switch which makes them impossible to switch on unless the car is stopped. Back seat screens, OK, but the front seat screens are absolutely irresponsible. Don't they realize that there are a LOT of dumbasses out there who will kill people because they did not see the car in front of them stop because he was watching Kim Catrall bone the delivery boy?

And Larry, I am not a prude. I'm rather an Asia Carrera fan myself  Smile/happy/getting dizzy. But I don't show it to the whole neigborhood.

To be honest, I am sort of stunned that we need to even have the discussion. My perspective: those who would show porn videos in a car such that they can be seen from outside are showing contempt for everyone other than themselves, hence showing that they in turn are worthy of contempt.

Another issue to consider is - what's deemed as porn anyway? It could be just a makeout scene that will raise hairs on the backs of all those prudes. As for little children - does the world HAVE to revolve aroudn them? That's why TV sucks these days anyway - words are replaced (mellon farmer instead of motherfucker, god damn is replaced by something like gosh darn) and there's nothing worthy to watch anyway.

I agree with both of you two. I am concerned about over-zelous police officers and them having just one more reason to search someones vehicle.
Even though the guys who would drive around town in a SUV with porn videos playing are mostly complete jerks with absolutly no game what so ever, I still think they have a right to watch what thye want to watch on TV in there vehicle.

Having children is an individual choice. Someday I will be a parent. I will have to accept the fact that someday my son or daughter may see d!*k, hairy bush and large breast on TV and reality when they get older.
(of course I'll keep my videos hidden under lock & key).

I still think they have a right to watch what thye want to watch on TV in there vehicle.

OK, look at it this way. Agreed, you can watch your bestiality or kiddie porn tapes if you want in your car or wherever you want. But if the screen is positioned in such a way that it is easily visible from outside the car, i.e. if it is above window-sill level, it can be considered as public display or even broadcasting. You are not supposed to do that. Also, remember that at the beginning of all these tapes is an FBI warning about making copies, and public display etc.? So it's already illegal in a way.

But in any case, TV screens in a vehicle are a terrible idea. For the driver there should be no question, and if there are passengers, well, whatever happenend to having a conversation?

A lot of my porn has me and my girlfriend so most likely it would be me and my wife. That's why it would be under lock & key.

I read this thread towards the end of last week. Ironically, saturday night driving down the highway, I exprerienced it first hand. Caught a little porno movie through the window  Laugh out loud. It was hilarious. Funny thing was they had tv's in the back seats, however nobody was sitting in the back.

I am sorry but I have to comment on that line...people have sex shoved in their face constantly. It's on TV, in ads, in magazines, in the news...that was a really pointless comment. Sure, people draw lines. Long ago seeing a woman's ankle was...well let's just say, if you weren't married to her you just might be scarred for life.

Personally I hate people driving distracted...on phones, watching or doing something else, so I hope they throw the book at this individual...and Carolyn is right...that kind of thing should not be in plain view.
