What Is An Annulment?

Fri Jun 04, 2004 7:54 am

I am just wondering what the difference is between an annulment and a divorce?

Annul: to declare that a marriage was never a proper marriage in the eyes of the church, for example because one of the parties was not completely committed to it

Divorce: official ending of a marriage: the ending of a marriage by an official decision in a court of law

Got this from the Encarta dictionary...dunno what the difference is exactly though. Hope it helps  Smile/happy/getting dizzy

I believe that you can also have a marriage annulled civilly. Same effect but a marriage that is annulled by the church still has legal consequences.

Basically an annulment is the Catholc method of ending a marriage that will allow you to get remarried in the church. It differs from divorce in that annulment states the marriage was never valid, meaning it never truly existed, while divorce maintains the historical existence of that marriage.

In my opinion the difference between annullment and divorce is from the legal point of view: annullment declares that marriage never existed due to preexisting reasons which made the act of marriage illegal from the very beginning (i.e. bride being in fact under the legal age, groom "forgetting" he's already married or some factors of religious nature) and there should be no consequences such as splitting the property, etc.

Divorce is an act, terminating a legal marriage.

It is a legal statement that the marriage never took place - This was really important in the old days with royalty. King HenryVIII had his marriage to Katherine of Aragorn annulled so he could marry Ann Boleyn. Now it really only happens in the afore mentioned circumstances or when the marriage has only lasted a really short time a`la Brittany Spears.

There is correctness in this thread. "Annulment of a marriage" is the civil and/or religious way of saying it was never valid or more abstractly, did not exist.

The two usual reasons for annulments are for religious and legal situations.

Here are three common reasons why people get marriages annulled...

Religiously speaking, the Catholic Church will not marry a divorcee who was married in the Catholic Church previously. If the marriage is annulled, however, the Catholic Church will marry that person.

Legally speaking, someone may choose an annulment because it changes their legal standing in a situation, such as an inheritance.

People may also choose annulments for personal reasons. For example, someone may have been in a short and very abusive marriage. Choosing an annulment is more symbolic on a personal level, to almost help that person to forget or refuse to acknowledge that the marriage existed, thus being more a sense of closure instead of a divorce.

An annulment is a declaration stating that the marriage was never valid, while divorce is the legal dissolution of a marriage.

Anyone else want to say the exact same thing?

I do!

An annulment is a declaration stating that the marriage was never valid, while divorce is the legal dissolution of a marriage.

Quick, the thread isn't long enough yet, someone repeat me!

It doesn't only happen for marriages that last a short time, Nancy. My mother, when she was workiing, had a boss (who was a real bastard, apparently), who, because he knew one of the Bishops in the Cleveland Catholic Diocese, got his 25-year, 3-child marriage annulled so he could marry his young mistress.

Well, what goes around comes around-three months later, he died of a massive heart attack at his desk at work-found by my mother, of course.

The Catholic Church allows a payment to get an annullment, btw, which, to me, is a form of hypocrisy. I differ greatly with The Church on it's stance on divorce. It will forgive a murderer who confesses to a priest, but won't forgive a bad marriage via divorce.

I can think of another word beginning with "A" that KROC's parents should have gotten in the mid '70s.

You can also get an annulment for non-consummation of the marriage, correct?

KROC -- maybe you could get an annulment then.  Big grin

That alone almost makes it worthwhile. Maybe we should start a national campaign for this, and put thousands of greedy lawyers out on the street to do honest work.  Big thumbs up

I think the Kennedy's bought a couple annulments from the church too. Legally, I don't think that works unless you have a really good reason (ex. bigamy). They church annulment is so that you can get remarried in the church, you know, so you don't offend God by living in sin. Apparently dumping your wife of 23 years and calling your children illegitimate is okay though.

HAHAHAHA, I have to agree with Alpha1, there is a strong sense of revenge there.

And basicly why shouldn't gay people marry? That way then can get divorced and be just a miserable as the rest of us.

Here's a succinct link about Joseph Kennedy's attempt to get an annulment from the Catholic Church so he could remarry after divorce.

What's next, buying papal indulgences again?

I fully support gay marriage--actually, any marriage.
Because it will likely lead to divorce.
Which likely requires a lawyer!
