US Customs Agent Sued For $5m By Tourist

A chinese tourist intends to sue US Customs for US$5 million over an incident that occured while attempting to enter the United States in Niagara Falls last week.

US Customs agent Robert Rhodes faces criminal charges for use of excessive force to cause grievous bodily harm for his actions taken against Zhao Yan at the Rainbow Bridge.

Rhodes mistakenly assumed that Zhao Yan was involved with a drug smuggler attempting to flee the customs checkpoint and threw her into a wall, grabbed her hair, kneed her in the head and struck her head on the ground before spraying her with pepper spray. Zhao suffered swollen eyes, bruises around the face and a contusion on her forehead.



The Chinese government described the act as typical of "hegemonic attitude and racial discrimination" of the United States and called for a condemnation of the United States by human rights groups.

Nowhere did I see any mention of her fleeing from the police. Had she done that, the case might be viewed differently; innocent people don't run.

Again, I didn't see it mentioned. But that doesn't necessarily mean that she didn't.

But if this is a case of a cop wearing his badge on his dick and beating a person senseless for no clear probable cause (i.e. running, resisting arrest, etc.), then this "cop" should be fed to the lions.

I feel that if the cop did do this for no reason he/she should eb prosecuted. However this does not reflect "typical hegemonic attitude and racial discrimination of the United States" thats just utter BS there, and the Chinese just trying to get some political play, Hell the chinese government have no place to even remotely talk about violations of human rights.

The US government then played images of the dude getting run over by the tank.... bent over, and mooned the chinese government.




This cop on the otherhand needs to get ass raped in prison for a while...

Damn! She looks pretty f*cked up. The custom agent must have enjoyed beating a woman. I really hope that he will get the same treatment in prison. Even if the woman has done something wrong you don't beat the crap out of a woman like that.

Well, here is what was reported to have happened, from the Buffalo News;


The incident started when a male pedestrian had cleared customs at the bridge, before he was found carrying several pounds of marijuana.

According to an affidavit filed in U.S. District Court by the Department of Homeland Security, Rhodes hit the "duress" button and called for assistance. He later told superiors he asked the three women to come inside the inspection station, but instead they started to run. He then grabbed the nearest woman, Zhao.

Rhodes told officials that the woman tried to pull away from him and swung her arms at him, before he sprayed her with pepper spray.



Now, I'm not saying that beating the crap out of her was completely justified.... but really, if you take a swing at a LEO, then you're setting yourself up for an ass-whoopin'.

Lesson here; if you're innocent, don't run away - It makes you look guilty.....

Well, she was maybe about 5 feet tall. Was the officer wearing a uniform or was he a plainclothes cop? I had a friend driving away from some people he considered trying to do a carjacking. I reality they were plainclothes cops who wanted to check his driver´s licence. He only found out when he got pulled out of his car by some uniformed, guntoting cops a few blocks down the road.

What do you mean, 'a logical progression of events'? I can somehow imagine an officer use some force with a woman who acts suspicious, this doesn't mean you have to beat the hell out of her!

You also have to take into account the possible culture and language barriers. WHo's to know that she really know what was being asked of her in that position or that she was utterly confused by the entire situation.

Seriously though, this is an inaccurate statement. When there is trouble, people scatter. Innocence has nothing to do with it. Its self-preservation.

How often have you read similar reactions when a gun fires? People run. If I saw a disturbance in an airport security line-up during a period of increased security, I might be inclined to back away myself. For all we know this lady may have thought she was fighting for her life.

Either way, I'm sure the big brave(?) officers could have subdued this lady without resorting to this kind of violence. Sounds like a case of run-away anger to me.

Funny (and true) story....yesterday I was on an NWA flight from MSP to YWG. I was in row 2. Some guy in row 1 wandered up to the service area in front to ask the flight attendant for more coffee. She asked him to immediately return to his seat for "security reasons".

She then brought his coffee to him and asked if he was "Canadian". He answered "no" and she continued to tell him in a hushed voice that it is quite typical for "Canadians" to rush the cockpit area in an inappropriate manner. "After all" she continued, they "didn't lose 3000 people so they couldn't possibly understand how stupid it is to approach the cockpit".

I stewed for awhile and decided to remain silent....since I had already spent a week successfully biting my tongue in the land of "we are the best screw the rest". This bitch would have probably written me up as a hostile passenger or something. After all, I was an "offensive" Canadian....

Assaulting a officer of the law isn't a small issue, no matter your language differences. He used his judgement, made a choice, and his objective was to subdue her.... and he did just that. His judgement and choice turned out to be wrong - but that should be cause for a disciplinary action, not the loss of his job. It's my belief that he did the right thing for the right reasons, but only to the wrong person.....
