Legal Action - Username A Trademark

Right...

I have been silent for the best part of a month now.

I have been "asked" to stop posting under the username "Worldoftui" because it is a registered trademark http://www.worldoftui.com

I received a call to my home phone. It appears some sort of private security solutions company which has been hired by TUI UK as it appears as though I am putting a poor light on their image.

To be honest, I think it's pretty scary. I have NEVER posted my surname, only my first name and my home town. They advised me that they had been watching me for a while and had traced me via the phone book, even though it is not my name which is printed.

I think the whole thing is a little creepy, not to mention pathetic. I see several users with "Airbus", "Boeing", "Delta" or whatever in their names and I cannot imagine them having this issue.

Someone PLEASE tell me if they actually thought I WAS representing the views of the company.

Don't get me wrong - I can understand that companies are protective of their image. But I am not advertising, using company imagery or typeface, or even pretending that I am working for them any more as I am not, and have not been so for quite a while.

I really did not have the intention to piss anyone off by chosing the name, and have agreed to cease its use, again because I do not need the hassle at the moment, and because I really am not into creating work for people.

So, my questions (after my rant) are...

1. Do you think that they were right to take this line and insist that the useage of the name be stopped?

2. Has anyone else had this sort of problem?

The user has deleted himself, I can confirm that nobody of the mods or admins banned him (I didn't get an eMail telling me so).

This is really strange! And too be honest, I can not understand it because most of the users have an airline or an aircraft type in their username but I never heard that any company complained about that.

Someone is promoting your company name on an international aviation internet forum and you force him to stop it  Nuts. You can see that there are enough morons working in the marketing departements of some big companies.

I can CONFIRM that this was no scam.. but not going into the specifics on here.

They can keep the name. The name is not really what I was bothered about. Its more the fact that they were so bothered that they decided to find me at home.

But be my guest Commander_rabb - if you wanna deal with legal action, go right ahead. I really don't mind changing the name - I didn't like it much anyway. Plus as I said, we are all busy, last thing we need is people creating extra work, especially as I would probably only string it out for a while before eventually agreeing to change / delete it anyway. I don't want to be a time waster.

Isn't it sad that some people just don't have any respect for trademarks? They use them on forums or play around with them and come up with similar sounding names like PFUI which loosely translates as YUCK.

World of TUI is a pathetic company. I'd laugh in their face. If they took me to court I'd laugh even more. Like they have money to spend on irrelevant things like that...  Yeah sure Looks like they'd be more wise to spend that money on a web site that doesn't suck.

You would stop laughing if you would actually receive a letter of caution which mentions a 30,000 $ fine. It's easy to pretend being brave enough to "laugh into their face".

I know what I'm talking 'bout, since I did receive a letter of caution which was issued by "a world leading publisher of information" (their words) and linked to an EUR 30,000 fine. I fought back and won, but I didn't exactly feel comfortable.

In the case of BananaBoy, it's simply not worth it.

Not to compare you to a whore, but there was a similar scandal recently about an high-class escort who uses the name Chanel.

She changed it to Chanelle. Then she changed her website so there was no similarities in style to any Chanel ads etc. It got worse and worse.

I think she's now Charlene or something.

Good for you not wasting your time with a stupid battle....crappy as the situation is for you.

I think that it is pathetic for them to take it out on you like that. As you mentioned, if that happened with companies like AA, Delta, Boeing Airbus etc..., then many people here on a.net would be screwed.

Something's not right here. You say your name was never given out on this site, so I can only think of a few possibilities:

1) You had photographs on here showing your real name.
2) Airliners.net disclosed your name to a third party on request (I seriously doubt this).
3) The company contacted you via the site and you emailed them back, thus giving them your name.
4) You have a presence elsewhere on the net, where your name is visible.
5) You have a website where your personal details are registered against the domain.

Even so, I find it odd that they would even bother. Are you completely sure it's not a friend or associate that has successfully stitched you?

I was too shocked to even really delve as to how they found me, but at the end of the day, they are professionals at that sort of thing.

Only thing I can think of is that I have often stated I worked for Lunn Poly, was a Shop Manager etc, plus I have my home town on my profile.

To be honest, LP was a mainly female company, so there wouldn't have been too many guys to find with the name "Mark" working in Reading.

You should click on the link at the top. World of Tui is the "master brand" for TUI AG. Basically airlines, hotels, travel agencies all linked by the smilie thing.

Well if TUI got in contact with A.net with a legitimate reason to get Marks IP address then A.net would have to oblige. Once you've got someones IP address you can contact their ISP and get their home address and phone number. If your a legit authority of course.

I asked my dad who's got a law degree and who is now an IT director so he's probably not wrong Laugh out loud

Mark, I have only seen today that you have been forced to change your username.

I don't blame you in the least for ridding yourself of the 'Worldoftui' username given the circumstances. From what I have seen you have never spoken badly of TUI, in fact in many cases just the opposite! I even remember seeing on your profile that your signature stated that your views in no way expressed those of TUI! Most right minded people would say you have been very unfairly treated by them, tracing and contacting you. Goodness knows how they managed to track you down, but they are completely out of order and has only undermined my opinion of them further. At least you can now say that BY is sh*t compared with how they used to be!  Wink/being sarcastic

I've always respected your comments and will do so in the future under your new username of BananaBoy.

Thanks for the kind words.

Yes, in general, I spoke highly of the Tui group. I still have a belief that they have a great range of products, but at the end of the day, even with the disclaimer, they were not happy. Shame really. But such is life.

IMHO I think that World of TIO or TOFU...whoever they are...are afraid of their image being outside of their control. I don't think that they are afraid of you using their property, I think that they may be micro-managing their image. Just a thought.

It's not like he was attempting to pass himself off as an official source of any type with the company, in fact, he had a disclaimer stating that!

All TUI's succeeded in doing is displaying what a petty organization they must be. Glad I'll certainly never have the [dis]pleasure of dealing with them now  Big grin

I've once had a bit the same kind of issue with the local authorities here in Finland.

I got an email telling me I can't use the ICAO code of Helsinki airport (EFHK) together with my name, because "people can get me wrong and think I work at the airport"  Confused

I've seen many people here and elsewhere using an airport code in their signatures after the name just to give the idea what's their local airport and so on.

Now, would an airport have a right to tell me if I can use an ICAO code together with my name or not?

Pretending to be an employee in an airport or airline would be a diffent situation. This is anyway just a discussion forum after all...
