Our Honda Pilot Was Destroyed

Back on Friday, 2/25/05, my mom was driving home from work when she was rear ended by a large commercial truck going 45mph. She was at a complete stop. Thankfully she is ok, just has a bruise from her shoulder down her chest from the seat belt. In my opinion, the car held up fairly well considering the conditions. Both the police and the body shop said it is likely to be a complete total. Just curious, what are your opinions? Totaled? Not Totaled? It was a great car.  Sad

Totaled, it will be scraped and all things of value removed, like the seats, radio, motor, rims etc. The cost to replace all that metal work would not be worth it.

Even if they fix it... it will never be the same again.. I suggest hoping the adjuster totals it and gives you a reasonable check for it.. otherwise sneak over the fence at night and set fire to the thing.

Trucks carrying wrecked cars to their final resting places are a common sight in my town because it's home to several large junkyards. All I can say is that many of them have a lot less damage than your family's Pilot. Maybe there's some way you can appeal if the insurance company wants to junk it, which certainly looks as if it'll be the case - check the policy, there might be some sort of arbitration clause.
By the way, the large truck that hit the Pilot was not going anything close to 45 mph at the time of impact, had it been doing so the damage would've been far worse.

According to the truck drivers statement given to both the police and his insurance company, he was going 45mph. But if you insist not, what would you say?

I really hate seeing it go, it wasn't even two years old. KBB still lists it as being worth $24,000 est, but who knows how much we will receive from insurance. Also being that it was a commercial truck owned by a moving company, I know that we do plan on taking them to court. So either way, we will be able to swing a new car, although again I hate seeing the car go.

Why do people always assume that because there is a company involved instead of a private individual the pockets are any deeper? Their insurance may be deeper but if you get a reasonable price for the car or your insurance covers the cost of repairs what do you honestly plan to gain with this frivelous lawsuit?

The vehicle did it's job absorbing the blow and transferring as little energy, as designed, to the occupant. Be thankful, move on and get a new vehicle. Scrap that one.

Considering that it looks like a small white-filled square with a red x, I'd say it's totaled.

I always felt the same way... until now. Until it affected me. My mom has bruises across her chest, along with some severe pain. All because of a careless driver, one who was supposed to be more responsible then the average driver. I myself do not know how far they will get either, but it will be interesting to see, and I do hope she wins.

Anyway, I don't want to turn this thread into an argument over a law suit. But, I do find it slightly weird that my mom walked away from the accident, yet the guy who hit her, who was out walking around after the accident went away in the ambulance. Could he be going for workers comp. due to the fact he could lose his job over this?

I wish I could see the pic's they won't load on my computer. I have a Honda Pilot. If there was anyone seated in the 3rd row seats would they have been OK ???
Next time try the old "dirty Sanchez" She'll love it !!!

Seriously glad no one was critically injured . . . . the physical injuries to your Mom will heal, hopefully the mental ones will as well . . . .

I worry much less about injury when I'm going about my business in my BAFDT.

Yeah, that car is definitely totaled. Not only are the costs to fix it high, but by California law, cars that have a damaged frame must be totalled.

As for the car, don't worry about it. I lost my car when it was one year old and though I still miss it at times. I have gotten over it. Like the others say, be thankful that you all are safe and suffered no major injuries.

DC10GUY, if you would like, I can email the pictures to you. They mean quite a deal when you own one. Its hard to say about the 3rd row. Chances are one would be quite injured, but I don't think it would result in a fatality which is what amazes me giving what happened and all.

Pictures arent showing up but from reading the comments, I would assume that even if they fixed it, when it comes time for re sale or even if you get in another accident you are dead. But when it comes time for re sale you are going to find that you have a bent frame, so either way the car is totaled.

It may end up costing you more in lawyers fees than the actual settlement if you get a judge with the good sense to toss it. In a civil suit you can't seek money "just because" you kinda have to have an idea of a remedy and be able to back it up. Punitive damages can also be included but some states leave those up to the judge. The driver was acting as an agent of the company but you may want to include the driver in your civil suit anyway in case the company has a good lawyer and can wiggle out of their responsibilities. Chances are the driver can't afford that great of a lawyer and you want your money. You will probably bankrupt him if you win, or even if you don't, maybe put the company out of business if you seek a large enough reward, but that is all ok, your mom has some bruises and was a little shaken up oh yeah and your car, which probably still had signifigant value I am guessing was totaled (but the insurance already is paying you for that)

I have had relatives in car wrecks, 2 of the 3 times the other parties were people with no insurance. Nobody was seriously hurt (much like this accident) but because there was no signifigant injury and you cannot get blood from a stone there was no point in going after the people in court. I understand you want your pound of flesh for this but look at the bigger picture, if everyone sued an insurance company every time there was a wreck just because they thought they were entitled to more money how high would the premiums go? Then how long before insurance becomes too expensive for even more drivers?

Note: If there were signifigant lost wages, or will be ongoing expenses from this not covered under the intial claim go for it, sue their pants off.

CaptOveur - We are not suing just to sue. My mom has been out of work since the incident, and been forced to use a rental car, which is not covered under our policy. We are not out there to bankrupt the guy or his company, or to win money for no reason, but because my mom currently out of work and being forced to pay for a rental car. Both of which should be payed back by the company. No extra money will be sought as insurance is making sure we get a new car.

Did I miss something? YOU are paying for a rental? I would assume that as you all got hit, their insurance would cover the cost of a rental.

Correct me, fellow Floridian posters here, but here in FLA, if you hit someone in the rear, YOU get the ticket, and responsibility for the accident. Wouldn't THAT law apply across the country?

I would suggest that as soon as the compensation check arrives you place an order for a new Pilot--or hold off and get the second-generation Pilot that's due about a year from now.

(Note: Honda will unveil the second-generation Acura MDX later this year, so the related second-generation Honda Pilot may follow a few months afterwards.)

That alone is something worth going to court over (because the insurance company is naturally going to resist paying), and the lost wages that have been mentioned. I was under the understanding when I posted my bitch-fest about this being an overly litigious society that everyone was ok and his family just wanted to cash in at the expense of someone else.

AFAIK, EVERYWHERE you go, you hit someone in the rear, you automaticly are at fault. Even if the person in the front deliberately slammed on the brakes for no reason and you were going on the speed limit.

I'm glad your mom is ok. She easily could have been more seriously injured. I'm glad it turned out so well.

As for the car, I don't much care for the Honda Pilot...But it is still an ok car. From the sounds of it, yes...it is totaled. Be glad that Honda's hold they're value so well. That will help you guys with the insurance check. They don't depreciate as much as other vehicles. If you were in a Toyota or Chevy, or Ford, you could kiss a big check goodbye. My guess is after you use the check to pay off the rest of the value you owe on the car, you won't have much left, though.

I know it is not ALWAYS the case that the person in back gets faulted but that is usually the first assumption, from then on the burden of proof is on the person in the back. That is why I am careful when I brake check the tailgating ass-clowns in penile compensation trucks on the highways around here.

This sounds a lot like the "Law & Order" that was on TNT, last night, dealing in faked auto accidents, and who's responsible.

When we got nailed, back in 1998, by, to quote the very quoteable CaptO., the "ass-clown" who hit us had no insurance. Luckily we had "uninsured motorist" coverage, and I got a check for a rental car. My insurance company then took the driver who hit us, to court. And I get the feeling that THEY like to sue people. I had a call from them, just looking for more reasons to go after the guy. Amazing.

That Pilot is most likely going to be an economic total.. My Camry was totalled with less damage than that (although it was a much older car, of course). Have your mother go to a bank (my mother went to her credit union) and look at their NADA guide. My mother got $900 more for my car from the insurance company because she corrected some of their bad assumptions.
