Staring. This one always got me... I never got it... Why is LOOKING at someone harrasment? I can understand if your standing there staring at someone while blatantly masturbating, but if your just loooking who the FU¢K CARES??? I guess it might be annoying to be stared at, but if they never so much as talk to you??? Whatever..

Well I actually have an interesting story today about "walking the line." Short version a co-worker (who is attractive) e-mailed me that she got ink on her boob and had no idea how to get it off. So we went bank and forth for the afternoon, but I think that shows how you never know, because some people care and some don't. There is another girl at work who would be completely offended by this. So, best advice, be careful.

Here ya go, right off the website.

Sexual Harassment “Sexual harassment” is defined by law as unwanted sexual advances, requests
for sexual favors, or visual, verbal or physical conduct of a sexual nature
when:
• Submission to this conduct is made either explicitly or implicitly a term or
condition of an individual’s employment
• Submission to or rejection of this conduct is used as the basis for
employment decisions affecting the individual, or
• The conduct has the purpose or effect of unreasonably interfering with an
individual’s work performance or creating an intimidating, hostile or
offensive work environment
Sexual harassment also may be in the form of non-sexual, offensive conduct
that is directed at a team member because of his or her gender. Sexual
harassment is not limited to conduct motivated by sexual attraction and may
occur between members of the opposite sex or members of the same sex.
Wells Fargo’s policy is broader than the legal standards. Our policy may be
violated even if the person did not intend to give offense, or believed his or
her conduct was welcome. Examples of prohibited sexual harassment include,
but are not limited to, conduct such as:
• Written harassment – sexually suggestive or obscene letters, faxes, email
messages, notes or invitations

• Verbal harassment – sexual comments, advances or propositions, derogatory
comments, slurs, jokes, and comments about an individual’s body or
appearance, including comments made on voicemail or another recording
• Physical harassment – assault, stalking behaviors, sexually suggestive
touching or body contact, and impeding or blocking movement
• Visual harassment – sexual gestures, leering, inappropriate display of
sexually explicit objects, pictures, cartoons or posters
Harassment Based on In addition to sexual harassment, other forms of harassment may also
Other Characteristics interfere with a productive and respectful work environment. Wells Fargo
prohibits harassment based on an individual’s race, color, gender, national
origin, religion, age, sexual orientation, gender identity, physical or mental
disability, pregnancy, marital status, veteran status or any other status
protected by federal, state or local law.
Remember that Wells Fargo’s policies are broader than federal, state or local
law. Prohibited harassment may include, but is not limited to, epithets, slurs,
derogatory comments or jokes, intimidation, negative stereotyping, threats,
assault or written or graphic material that denigrates, shows hostility or
aversion towards an individual or group because of the characteristics
identified above. Wells Fargo’s policy may be violated even if the person did
not intend to give offense or believed his or her conduct was welcome.

Best watch that. We have had quite a few people get fired for e-mailing what I imagine got a little sexual.

Anything someone says it is. And the burden falls on you to disprove it. Hopefully you will get to keep your job after a false accusation by someone who just doesn't like you, but probably not.

On my phone, I have a picture of three guys in speedos. Even that could be sexual harrassment. WTF?!?!? I just went through a management training course over the last two days and this is one topic we talked about. We have one girl that touches some of the guys arms. Nothing more. That could be sexual harrassment. I don't hear any guys complaining....

In our office, we have this one bitch that complained about a guys picture of his wife and family on his desk. It was a beach picture, and his wife and daughter are wearing bikinis. It's not at all "sexual" but he had to take it off his desk.  yell

What Is Sexual Harassment (workplace)?

Maverick and CaptOveur hit the nail squarely on the head - it's whatever the person leveling the charge says it is.

Companies aren't interested in justice - they're interested in keeping the peace and not being sued for inaction. So if you have someone who levels a charge of harassment against you - whether real or imagined - expect to go through some form of "counseling" by your employer's HR department or be disciplined up to and including discharge.

And no, it doesn't matter if there's proof of your innocence - you're still guilty.

If it were my company I would have told the whiney bitch to pack her desk and leave. I would have probably been sued but you have to draw the line somewhere... She was probably jealous the guy's wife looked better than she did.

CaptOveur,

Absolutely!! The girl is a whale, and doesn't have a clue. But at the same time, EA CO AS makes a solid point, and one which our company chose. It really didn't matter if it was, or wasn't.... they told the guy to take his picture home, and gave him the, "if you do something like that again...."

The whole damn office knows it's a cop-out, but in the company's view, it doesn't matter, she sad she was offended, so she is right!! Pure BS!!

I can do you one better on the "You've gotta be ****ting me!" meter - we had a woman in the office who was around 7 months pregnant, and was getting pretty big. One of her friends came up to her and patted her belly, asking how she was doing.

A COMPLETELY DIFFERENT woman, seated 20 yards away saw this - and filed a complaint, saying the friend sexually harassed the pregnant lady by patting her belly!

The offending "patter" - whose friend never complained in the least and STILL had a complaint filed on her behalf by that busybody who saw the pat - was given a talking-to by HR, and a letter put in her file.  Sad

I once made a comment that an office smelled like fish, but nobody had eaten fish there... so a female coworker "understood" I was talking about her smelly vagina...My ex-boss called me over and discussed it with me, almost laughing, and then remarked that he too thaught it smelled like a fish market...

Well, the last time I had to attend the worthless "anti-discrimination" training, our wonderful HR department said that sexual harassment is defined as "whatever a reasonable woman thinks it is".  Wow!

Of course some smartalek had to raise his hand and say "I'm sorry but I've never met a reasonable woman!"
