Landlord From Hell!

We've all had them. I am so mad right now. I literally want to break things. Here's the long of the short of the long:

I moved into a premier loft community 355 days ago(August 04). I am not accustomed to any one lifestyle, but I expect at least what I am paying for. When I moved my apt. wasn't made ready, microwave didn't work, a coax cable was hanging in the middle of my living room, start knob was broken on dryer, and a window wouldn't open. All my stuff was here so I had to finish the move.

That day I turn in work orders on all the stuff. The dryer was fixed in December, new microwave in January, gave up and fixed the window myself in April, cable fixed in June. These were all minor things that could have been fixed in one hour, not ten months. And it only got fixed because I took command.

Now we have new storage units in the basement. I rented one on Monday, and still haven't received my key to the basement. Come Monday they're going to see a whole new side of me. They have taken advantage of my gentle disposition for too long. So starting Tuesday, I may be posting from my jail cell. I hate lazy people!

Read your lease carefully. If your lease says the landlord is obligated to make repairs and didn't and you paid for them yourself, you could try withholding the same amount from your rent, but only if the landlord agreed to such an arrangement. If not though, it would certainly get their attention.

JeffSFO is right - read your lease and know your rights under the law.

Also, as far as I know, the landlord is not allowed to enforce any parts of the lease which are illegal under the law. For example, if your lease were to say "tenant is responsible for maintaining the heating and hot water systems" and the law says "the property owner is responsible for maintaining heating and hot water systems" then that part of the lease would be invalid even if you signed it.

Also, put everything in writing. Texas probably has a stipulation like Ohio: repairs must be made within a reasonable amount of time. For example, a cracked window should be replaced within 30 days but a leaking toilet should be repaired or replaced within 7 days. A serious problem like a gushing pipe or a ceiling collapse is an emergency repair that should be completed within 72 hours. If you have a written or time-stamped phone record of notice to your landlord, that will help you make a case if you have to pursue legal options. Although it cost me money, all of my repairs in my last apartment (basically a slum) were completed within the time I specified once I started sending my letters certified return-receipt (approximately $3.00 per letter.)

Finally, make sure that if you decide to withhold or short your rent payment, that you do it within the legal boundaries. Here in Ohio you are not allowed to simply withhold rent. You must provide notice of intent to your landlord, file a grievance in court, and deposit the full amount(s) of rent with the Clerk of Courts until the grievance is resolved. That means if your rent is $400 per month, you must deposit $400 per month on the 1st of the month every month until the court either refunds your money, releases it to the landlord, or makes another judgement. If you were to withhold rent without going through the legal process, you would have no recourse against a court-ordered eviction if the landlord filed for nonpayment.

Wow if that is what you call a land lord from hell I wonder what you would call a landlord that you had to get a restraiing order against...I did..Not to minimize what you have gone through those are sort of trivial things. Not getting a key wor a week is not what I would call a catastrophe...Sorry...

Did you read the rest of my post?

Regarding reimbursement for my fixing the window, it didn't require any parts. Had I known this in the first place I would've fixed it when I moved in. The bottom part of the window just fell off one day, and I realized I could fix it. I've obtained legal advice, and you are all on par with what I was told. I'm not after any money, but things will be made right. People shouldn't practise bad business.
