How Do I Get Out Of Jury Duty?

Mon Oct 24, 2005 8:20 am

I've got jury duty tomorrow. I don't mind going down to the court but I also have mid-terms this week and I really don't want to get stuck on a long case. Any good ideas on how to avoid being picked to serve on a jury? I was thinking of digging out my old military shirt that says "Killem All and let God sortem out!" What do you think?

Just tell them you are a student and have midterms this week.. That should do it.
Things were better when it was two guys in a dorm room.

Carry a copy of Das Kapital under your arm. It's guaranteed to get you out of jury duty.

And a copy of your class schedule. Thats what I did when I was away at college and i got jury duty notice. I told them i was away at school so they requested a copy of my class schedule and I faxed it to them.

Thanks for the advice. The school is here in town though so do you think that will make a difference?

While being questioned drop in the following comment ..

"I would make an very good juror, all I would hve to do is just look at the defendant and I could tell if they are guilty"

In New York they make it difficult to get out of jury duty, I have had to go through the selection process the last two times I was called, luckily both cases were settled before trial

You'll be able to get a education deferral on your jury duty until a later date. They'll probably just defer it until after your mid-terms.

I got called for jury duty back in July. I got a good week for it, as Monday was July 4th. Showed up Tuesday, spent all day there, didn't get called. At the end of the day, they called out a list of names and told us to come back the next day. Those who didn't get called were pretty much done with jury duty. The next day, I sat around most of the day, and never even got into a jury pool.

Odd you should mention that.I was called to jury
duty last week.After two hours,I was excused.The
defended fled.

But it is really tuff to get out of it these days. Here in the Inland
Empire(SoCal) they really have come down in not accepting
excuses.I actually was schedule for April. It took several
calls and letters to have it deferred to October 13 because
being self-employed,the economic timing was not good.

I never respond to the notice. If they don't send it registered or return reciept requested, there's no way to prove you recieved it. Heck, you may have moved out of state. Once you reply, you're on the list, you're screwed.

There's one county here in Atlanta that does the jury duty thing ass backwards. When you get summoned, it's for a jury pool for 1 trial, unlike in most counties where you called for a specific period of time where you could potentially serve on several juries. So there is a chance that you may get called several times in a year for jury duty. I found out about this when I was last on jury duty and am actually glad I don't live in that county.

That's a way to get out of it and then have a need for a jury yourself.

Arizona won't exempt you except for a handful of reasons. Here you can be called once every two years for service. Under the arrangement in Pima County, you are sent to the jury selection room until required for a trial. If you are not impaneled, you go back to the jury selection room and are sent to another one. Jury service is one of the few civic duties that one should not be exempted from, except for valid medical reasons.

Just tell them the truth and offer to return on a later week to serve. The jury commissioner or the judge should be able to accommodate you.

It is your civic duty to serve on jury duty. Can it be inconvenient. Yes. But it is one of your responsibilities as a citizen. It also allows you an inside glimpse at the legal system. Also, imagine if you were a criminal defendant or were asserting a civil claim. You would want to have fair, impartial, and educated jurors if you sat in the defendants seat, so give those defendants and plaintiffs the same courtesy.

The old joke on the Bob & Tom Show as that you could ask where the "whites only" water fountain is...that usually does it.

Or, here's a novel idea, you COULD fulfill your obligations as a citizen and actually serve on the jury and not look for ways to finagle your way out of it. I know, that's far too shocking an idea to contemplate.

I'm quite sure your mid-terms are as good an excuse as there is. Tell them.

In all seriousness, anyone know whether they can find you in contempt of court for blatant efforts to evade jury service like some of those suggested above? I'd have to believe that they can.

pre-edit: I think I just got my answer. My wife just pointed out that she got threatened with contempt of court for chewing gum - as a specator. Judge stopped the proceedings and ordered her to spit it out.

I'm not an expert on American law, but wouldn't it possible to get a deferral on jury duty for the exams? E.g. that our friend wouldn't have to serve this week, when he is busy preparing himself for his exams, but e.g. a few weeks later, when his exams are done? I don't think that he wants to shirk his duty, he just wants to be able to study for his exams without distraction.

I've done jury service no less than three times. I believe if you get called you should do it.
