Drug Dealer Freed - It Could Only Happen Here!

I've heard it all now!

A 19 year old drug dealer who pleaded guilty to possession of 83 wraps of heroin with intent to supply, and was even filmed hiding his drugs stash behind the bumper of his car, has been freed by a judge because our jails are "too full". Even the defendant's own solicitor told him that a custodial sentence was inevitable.

The man was given a 12 month jail sentence, suspended for 18 months, and 100 hours community service!

The judge is quoted as saying "you knew exactly what you were doing. You have, however, pleaded guilty, you are a young man and we are urged not to imprison young men for offences of this nature if they are of a comparatively minor scale."

WTF is going on here???!!!??? I was under the impression that 2 hits of heroin is enough to ruin someones life?? So, if I go out and kill or maim 41 people later today, it'll be seen as relatively minor? Yeah, right!

It's worth mentioning that this is a country which jails pensioners for failure to pay a small proportion (e.g. less than £100) of their council tax because they can't afford to pay it!!

Could this sort of thing really happen in your country? How would he have been dealt with where you live?

Honestly, I throw my hands up in complete disbelief!!

Send him to California...Lethal injection will do the job. What are wraps (83 is a lot no matter what)? He would spend some time in prison in the US

I guess it's a slightly slang term for small packets - basically a wrap is a 'portion' of just a few grams taken from a larger supply. Effectively, this guy had 83 packets ready to sell.

By the way, I forgot to mention, he had his own 'business' cards printed too!!

We're not known for our sympathy towards hard drug dealers but IF the jails were "full" he would get home detention, I honestly think home detention should be scrapped as it isn't much of a punishment, however, commit further offences whilst on HD and you're in deep doo-doo!

Having seen the damage Heroin can do I would reckon they should get life and be left to rot.

I'd put a weeks salary that this slime bucket was back on the streets dealing within hours of this ruling. If the jails are 'full', doesn't it stand to reason that someone who has at least served some of their time should be released before this guy. Sure he pleaded guilty, but was there any indication at all that he felt remorse or was planning on changing his ways?

Here in germany he would have gotten a cosy little house and a great car of german manufaction .. and of course a personal "thank you" card from our president.

No honestly ... I doubt he would have gotten a heavy verdict here ... at max 1 year in prison or even less, probably nothing more than a couple of social community service.
If he would have been 4 years younger he could have been sent to a "education camp for hard to educate youths" in a holiday island somewhere in the world, for free of course, the 100.000 bill will be paid by us taxpayers!

I saw a piece on Portuguese TV about the German government (or some entity of it anyway) sending "difficult to educate" (i.e. proto-chavs) to Portugal for education. Problem is most of the "homes" they were put on were of people who had fled Germany for the exact same reason the kids were extradicted, and thought the hills of the Algarve were a good place to grow drugs. Most of the times they were just interested in the money they received for each kid and literally abandoned them, letting them do whatever they wanted.
Read this very carefully, I shall write this only once!

They should just inject drugs dealers with their entire stash in one dose. Would cure the problem very quickly, getting rid of the drugs, the dealers, and the shortage of prison cells all at the same time.

No mention in the article but I doubt it - if the guy had business card made, he knew what he was doing .... oooh, but I did forget to mention, he'd already been done for possession a month before!!!!

Not quite the same Cxsjr, but equally crazy: this country's most notorious drug dealer, John Gilligan, about whom a film ("Veronica Guerin", starring Cate Blanchett) was made, has spent the last ten years in prison for dealing in drugs (he was charged with murdering the above name journalist but found not guilty). His extensive property portfolio (worth €17m) was seized by the government.

Fine. But two weeks ago the Supreme Court ruled that the CAB (same as the Assets Recovery Agency in the UK) had no right to seize his property and returned it to him. As the Supreme Court is the final arbiter in such matters, the property, all bought from proceeds of drug dealing, is his to keep.

Although I agree he should have got longer in prison, it must be borne in mind that his crime is relatively a minor one, and he had spent 100+ days in custody.

As mentioned by some of our more proper-thinking peers, execution of violent offenders would free up space in jails for the "nonviolent" offenders to occupy.

Amazing! In my country even possession can immediately get you into jail, whether that is herion, cocaine or even marijuana depending on the quantity. Police is very strict about drugs.

Im saddened to hear this, all of the hard work that is put into this and he kinda walks free. Its the exact reason why i never wait for the end of court to hear the verdict, too much of a kick in the nuts when your hard work is trashed by a judge/magistrate.

Its certainly not a minor crime, drug pushing is one of the worst in my opinion. 112 days in custody is small fry for the damage that can be done with heroin.
83 wraps is still a significant amount - yes he may be low level but possession with intent to supply should be dealt with robustly by the courts...

I had a probationer that left the state of Arizona illegally transporting 100lbs of marijuana to Chicago. Got stopped in Russell, Kansas (Home of Bob Dole) by the Kansas Highway Patrol for speeding. Arrested. The good county attorney pled the case down to obstruction of justice. He told me that he couldn't afford to prosecute him if he took it to trial. The only jail time he got out of the deal was the probation violation in Arizona.

Well if he violated the terms of his probation then hopefully the state of Arizona did the right thing and hauled his a$$ back to Arizona to finish his sentence

In the US (at least here in California) we have full jails. But that doesn't mean they don't send criminals to prison. It just means that they force them to share cells and/or let other criminals out early. I'm surprised they didn't let somebody out early to make room for this guy.
