US Visa Application Form - Very Stupid Questions

Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

Have you ever been refused admission to the U.S., or been the subject of a deportation hearing or sought to obtain or assist others to obtain a visa, entry into the U.S., or any other U.S. immigration benefit by fraud or willful misrepresentation or other unlawful means? Have you attended a U.S. public elementary school on student (F) status or a public secondary school after November 30, 1996 without reimbursing the school?

Do you seek to enter the United States to engage in export control violations, subversive or terrorist activities, or any other unlawful purpose? Are you a member or representative of a terrorist organization as currently designated by the U.S. Secretary of State? Have you ever participated in persecutions directed by the Nazi government of Germany; or have you ever participated in genocide?

Have you ever been afflicted with a communicable disease of public health significance or a dangerous physical or mental disorder, or ever been a drug abuser or addict?

Need I say more?

It is also for all of us a kind of amusement, when we need to go and file those forms. As far as I understand, answering those questions is part of the legal system. If you go and sign those froms up and still become criminal, once in the country, you will not only be a criminal and prosecuted for, you will also be prosecuted for not having said the truth.

As all our legal systems in the modern world work on only accepting the truth - in case of you will need to swear on - this is a part of, they need from you. I hope you enjoy your stay in the US anyhow and have a safe trip,

And the part asking if you´re disabled is just rightout stupid.

I want to know which lobby group got the question added about the Nuremburg Trials and the Nazi party. I personally don't believe the Jewish community have the kind of influence in the US they're credited for (ie US support for Israeli settlements in the West Bank is due to pressure from right wing Christians rather than American Jews). But that question about the Nazis is the one thing that makes me go, Wow, AIPAC or someone must have really put the peddle to the metal in Washington, I mean, there's only like thirteen questions on the form, and one of them is about Nazis? In 2006? Yowza. One in the back of the net for some K Street organisation or another.

If your going their to commit illegal acts, your not going to say "yes im a thief" and your going to run the risk of lying and be caught. Why bother to ask?

These questions are all there for specific reasons. Some may seem silly and outdated but they are all part of the process that has developed over the years. You want to come to the U.S? You WILL fill them out and you WILL fill them out correctly.

If you have a problem with the questions, leave them blank. Of course no visa will be issued but hey, it's all in your corner ain't it?

As was said, answer the questions, move on, realize there is nothing you can do but answer truthfully, and stop being so pissy about it.

Oh yeah, and don't forget to include the processing fee!  Silly

Two weeks ago I experienced for the first time that an immigration officer actually looked on the back side of the I-94W form. I immigrated countless times into the USA but I never saw before that anyone turned the visa form to look how I answered these questions.

Here's the thing. The legal system in the US has protections for the accused, as do most legal systems. This is to avoid prosecutors (that is, the state/city/federal government) taking advantage of their position. In the simplest terms, the protection is known by the phrase "you are innocent until proven guilty". But that's just part of it.

So with regards to the questions, if you are innocent no big deal. Just answer "no" and move on.

If, however, you are guilty of, say, terrorism, and you answer "no" it becomes much easier to prosecute you. You are, in essence, waiving some of your protection since you are not only guilty, you are lying. It then becomes much easier for the prosecutors to find you guilty in a trial. This is because prosecutors also have to abide by the law. They are not allowed to use unlawful methods to procure evidence. By lying on your form, you made their job easier.


As for the disability parts, this is also to diminish legal protection if you, say, attacked someone and then used an insanity defense.


The questions are there because that's the way the US legal system works. They weren't written to annoy you personally. They were written to ultimately protect the innocent from the guilty by making it easier to prosecute the guilty.

Hey SB, thanks for the response. I agree with you completly on your response to the questionaire on the US visa application.

However how many people are arrested, tried and then convicted in the US that have specifically filled in the NO box on the application. Im sure the number is minimal, ok that is still a conviction of some body. But I am rather perplexed to such questions as the Nazi's, how many of those despotic little mad men are still running around today, barring permanent attachment to a respirator and dialysis machine.

I think the EU must do the same now with all non-EU citizens with those latest Denmark offenses, It sounds really stupid, the forms, but we are like Disneyland, even without payment...

(And I even managed to get into disneyland without paying!)

I agree with most of that actually  Wink That is, I understand the intent of the questions. I'm just not so sure about the effectiveness.

As for the Nazi stuff, what's the point of taking it out? My father was in WWII and he's not dead yet if you know what I mean. If a person was 18 in 1943 he or she would be 81 today, so that person could still be up and about for another decade or two.

Who on earth is going to say to the question "Have you ever used an illegal substance" is going to say "Yes I have say will this affect my chances of getting in" I've heard 5 year olds are asked these questions as well.

Exactly. When you lie on the form, you've committed perjury and various other federal offenses. My favorite is misprision of felony.

If I'm not mistaken the Nazi stuff is part of some immigration requirements that have been around since right after WWII. It's just red tape really.

I'll agree with Ibhayi though that it is a real pain in the ass. My cousins flew to see me in Canada a few years ago and on the landing form for Canada there are a few yes/no questions and I told him before he came to just check the whole lot as "No" (questions like "do you intend to visit a farm in the next 14 days" etc etc) The idiot checked them all as "yes" and got totally ravaged by customs. Sadly this involved them confiscating about half of my biltong (the half that was not store bought - ah well)
