NY Man Found Innocent After 22 Years In Prison

A judge signed an order Thursday freeing a man from prison where he had spent 22 years after being wrongfully convicted of the brutal rape of a 25-year-old woman.

The nonprofit Innocence Project and prosecutors from the Bronx district attorney's office had asked for Newton's 1985 conviction to be vacated based on recent testing on a rape kit used for the woman after the incident.

Newton, now 44, was convicted of raping the woman in an abandoned Bronx building in June 1984. He was sentenced in 1985 to up to 40 years in prison.

In 1994 he filed a motion asking that new DNA testing be conducted, but the request was denied because the evidence was unavailable, the Innocence Project and prosecutors wrote in papers filed to the court.

The result "conclusively excludes" Newton as the assailant, according to the papers.

I fear, this doesn't prevent other people from death penalty. Good reason to think about it.

Speak to some people in South Africa. After they rape a girl its easier to kill her as well, because you might only get another few months extra. Now thats why death penalty might help. But lets not even go there...

Good he will be released, even if he's lose so many years of his life! Hope he gets rehab

Nice that he is now free and no doubt his mom will be looking down on him with a smile on her face  Smile

Will he get any type of compensation for this injustice and was the girl who was raped around to see him released? Did she have any comment on it at all?

I thought the most interesting part of the article was:

Remarkably, Newton, now 44, is not bitter about his injustice, according to sources who helped secure his release.

"Most of the men who are exonerated always seem more dazed and excited, but never bitter," said a source close to Newton.

This is the one of the arguments which is very valid against the death penalty. I have heard the quote that it is better to let 100 guilty men walk than to allow 1 innocent person to be a victim of the death penalty. Killing an innocent person has got to be one of the worst things imaginable for the alleged felon. Fortunately for this guy he can get out and continue his life.

I also have a question for any lawyers or law majors? Since this guy has been convicted of rape could he track down this person and actually do it without penalty (similar to what happens in the movie double jeopardy) or would this be wiped from his record. (This is just hypothetical and by no means means anythig its just a simple law related question I have regarding something like this)
