Copyright Question (YouTube Video)

So it appears (c'est une poire, oui) FIFA got their panties in a wad over the videos of Zidane's headbutt that people uploaded to YouTube, mine included. I just got a "video rejected due to copyright infringement" e-mail from YouTube stating "a third-party notification by FIFA 2006 claiming that this material is infringing".

The video was a 19 second recording of a replay on ARD, a public German TV station. So to you copyright wizards, is poor and downtrodden FIFA right or should I send a counter notice? I don't quite like how FIFA does everything to commercialise the game and put its brand on it, so the motivation is there.

That's total BS. YouTube was built on a foundation of copyrighted material. Last time I checked, much of their content was still that way.
Better to be nouveau than never to have been riche at all.

There is a notice saying copyrighted material can't be uploaded on the upload page.

Maybe not for upload, but there's still a bunch of copyrighted material on YouTube. Some people even break movies up in to 10-minute clips and post them all on YT. The staff does go through the content once in a while to find and delete that kind of stuff, but they can't catch everything.

That's right, you can find entire DVDs of Peter gabriel in concert on YouTube.

Although I'm no lawyer, I'm quite familiar with German copyright law that applies on here in Aloges' case. And yes, as I see it, at least ARD or ZDF (the broadcasters) could file a lawsuit against Aloges, although a legal dissuasion ("Abmahnung") would be more likely. But that is already quite costly.
