Not suprised, as this is a common occurance with celebs in the states.

Actually, she didn't. According to the article I read, she blew the minimum to allow an arrest, which I believe is .04 in California. They said she failed the Field Sobriety Test, which they combined with the minimal blow score to arrest her. I can actually see her fighting this one if her lawyer is smart.

Not only can it be a combo, but alcohol alone can be considered a reason. The law is written in such a way that the "legal limit" is merely the number at which there is no legal way out of the crime. .04 means that they can still consider you Driving Under the Influence if you appear to be impaired.

This is probably dependant on the state. In WI .08+ is OWI (operating while intoxicated.) .04-.07 is DUI (driving under the influence.) Most people don't understand the difference and use the term interchangebly.

Here, to be convicted of DUI, the officer must demonstrate that having a BAC of .04-.07 caused or contributed to poor driving. Usually, one is only charged with DUI if involved in an accident or is witnessed driving recklessly.

DUI is a charge that rarely sticks (but still sucks because you have to shell out for a lawyer.) An OWI charge is usually impossible to beat, but can be done with the right circumstances, a really good lawyer and the money to pay him.

All states have max .08 now. Minnesota was one of the last ones to lower it as of August 1, 2005.

Yes, you can be arrested and charged if you show signs of impairment. Being above 0.08 just automatically makes you guilty. If you are below 0.08, it will be a lot harder to prove impairment, and the officer must do a correct and well documented (video is preferred) field sobriety test. Often times, these will be pled down to either careless or reckless driving.

Thought I'd add my 2 cents as I learnt about this in my recent driver's ed course (speeding was my offence, not DUI).

The officer will normally do a field sobriety test and will document this very closely. If you blow under 0.8 then you can still be busted if he believes you are impaired.

Incidentally I saw a guy getting cuffed n stuffed at the weekend after tubing on the Salt River in Phoenix. He was so drunk he could hardly walk. Man, that guy is gonna have a whole library thrown at him, not just the book.

Just celebrities? Hmm. I would say that about 50% of people that I know drive drunk or have had DUI's and don't do it anyl onger. Keep in mind that legally drunk is two to three beers or so at a ball game or dinner.

1st offense, its usually community service(picking up trash on the road) v. jail. In most county jails in California, they are operating at excess of 100% of capacity. As for the drivers license, if I recall correctly, it was automatic that one lost it for a period of time. DMV hearing aren't newsworthy so the results never make the press. Besides how many people stop driving after the DMV suspends/revokes one drivers license. Regarding the vehicle I believe itsjustme can provide the up to date info on that.

California's DUI laws are for everyone except those with the $$$ . . .

First offense DUI's usually don't end in any of that, unless there is some sort of injury to someone else involved. Most celebs are caught on first offenses and seem to get the same or even worse treatment than what most get.
