I Get Sandwiched And The Ticket!

Sorry but I have to vent....for the 1st time in my life I have gotten a traffic ticket. $100 bucks and four points for following too close.

Well the short story is that today I get rear ended at a stop light, and pushed by the person behind me into the car in front of me. Basicly a sandwich job on my truck. My front bumper and grill are tweaked, horn won't shut off, airbags blown on the front. And in the back my bumper is tweaked and the frame has about a 10-15 degree bend in it between the rear axle and the rear spring hanger. Needless to say with that bend where it is, I can't drive it because the rear end isn't sitting right. The Kia Sportage that ran into my rear end got the worse-messed up front end and punchured rad.

The girl in the car is still on her dads insurance so she calls him to get the paperwork very upset. Cops show up and ask for witnesses, can't find any. Daddy shows up about half an hour to fourty five minutes later with the insurance. He starts playing CSI. Dad claims that a skid about 6 feet behind her car is from my truck (Why brakes would only leave one not two skid marks is beyond me). Dad disappears for a little while why the rest of us exchange insurance. Dad reappears and claims to have a witness that saw the accident. The cop goes talk to 'the witness' and based on that and that skid mark, decided to tag both myself and the girl for following too close. The witness claims that I hit the car in front first and then she ran into me. This of course is different then I remember. I remember being thrown back by the force of the impact into my rear and then forward when I impacted the car in front of me. In fact my face never made contact with the airbags, which I am convinced I would have if I hit them first....something about a body in motion will remain in motion. I also think the damage pattern fits my explaination, heavy in the rear from the first impact and then less on the slower and later front impact.

I have no idea who this witness is, where he was or what he exactly saw but he took the dad's version and decided that is what happens. I guess I'll find that out Tuesday or Wendsday when I will stop by and pick up their report.

I don't see where I have any other choice but to fight this.....In the State of Alaska you shouldn't be ticketed for following too close expectially when the Kia that rear ends you hits hard enought to bend your frame by about 10-15 degrees.
OBAMA-WORST PRESIDENT EVER....Even SKOORB would be better.

Oh boy. Sounds like 2 victims for a lawsuit, instead of one. Good luck. How's the neck?

Who wrote the ticket? APD? Troopers?

Who is the "Dad"? And where did this witness come from? CPT Kirk beam the witness down?

What were road conditions? Were you stopped at the light? What intersection?

If happened like you tell it, I'd fight it. Sounds like someone (the "Dad") has a few $$$ or might know someone and is trying to cover his daughters ass.

If you ask for a hearing on the ticket, Dad, Daughter, Witness, Cop all have to show up. If that "witness" is a put up job likely won't show. Case dismissed. Might cost you a few dollars in court costs, but you won't have any points on your license.

The weird thing is the daughter didn't do anything- if she's going to sue she can sue the guyinthe Kia. Is it possible to have an expert look at your car and make a determination?

Shouldnt he win his court costs back, afterall he is fighting to clear his name which should be free if he wins...

Looks like we are in the same boat!

I got a letter yesterday morning about my incident earlier in the week, the guy who i was pushed into is now trying to point the finger at me for running into him when I was pushed into him....

I have it covered though... At the moment i have a lot more to worry about! and now i have to get all this paperwork out of the way and take my pain killers!  Sad

Cold and Clear down here. It was about 2 so it was a quartering light from the front.

Boy I really want to, but I want to see the case file, I don't have copies of the photos they took, I want to see what that file says before I make a decision.

This I knew - I was searching for a name . . . .

Still, until you see the file, I wouldn't do shit. They HAVE to give you a copy of the entire thing. Get that and make your decision.

My thoughts entirely. The way you've described it, it sounds very suspicious. I would assume it's a crime on both the father's part and the phoney 'witness' if he's lying. I know that in the UK statements from witnesses who personally know any of the parties involved are treated with suspicion (or even dismissed).

Did you take pics? Did the skidmark line up with where your wheels would have been? And did the tread patterns match?
