Mom Sues Police After Son Dies In Custody

Fri Dec 29, 2006 3:49 pm

This is the first I have seen of it, Now the whole incident was videotaped by the T.V show COPS. The entire video is in the link. Now when the officer pulled up it was obvious this guy was high on something and he was not playing with a full deck, he was a danger to himself and everyone around him. Medical officials said the man's death was not due to police but because he had swallowed excessive amounts of drugs beforehand. The only thing in the video that suprised me was the Sgt, I thought he would have jumped in instead of lurching over, seeing how long it took the officers to restrain this man, I would of thought he would have started the CPR, giving another guy a breather from the struggle.

Now to the mother, your son died because he was stupid, you fuck with cocaine, you deserve what you get. How can you even try to file a wrongful death lawsuit against the men and women who were trying to help him? I have no sympathy for this man, you have to make choices in this life, he chose poorly.

WTF??? How the hell can she sue the cops when they did absolutely nothing that was detrimental to the guys health.

I don't think drug addicts deserve to die, murderers deserve to die. Although I do agree with you in the sense of bad things are most likely to happen if you fuck with cocaine.

Cocaine, Crack, Heroin, PCP, Meth, etc etc if you use any of them, you are gambling with your life anyhow. You might as well play Russian Roulette while you are at it. It might not catch you for awhile, but eventually you get the bullet. Again, everybody takes some sort of risk in life, people with common sense will try to avoid doing stupid things that may kill them. Apparently this guy was lacking it.

Just because someone gambles their life doesn't mean they deserve to die. If thats the case we might as well all be dead, living is a massive gamble upon ones life. That doesn't mean I think you deserve to die.

Things that you think are stupid may not necessarily be considered stupid by other people and vice versa, anything you do may kill you.

Although I will stop it there and let the thread go back to what it should be.

suing the city of West Palm Beach and the two "COPS" photographers, alleging they all contributed to Lewis' wrongful death.

What? When? How? They hold the friggin camera, how is that contributing???
Did they lay a hand on him? Did they shove the drugs down his troat?
Is this mother really that stupid, or is she trying to make a buck out of her sons death?

Gah, I can't see the video, anyone know how I can download it to my harddrive?

Lets just say that he had it coming. To bad that he had time to call the police before he passed. Then again, should he have died sitting in his recliner, his mom would probably have sued Lazy Boy instead.

No, but it's not a bad thing when they do. Natural selection.

I think this statement says it all.

"Medical officials said the man's death was not due to police but because he had swallowed excessive amounts of drugs beforehand. It is clear from the witness statements, physical evidence, autopsy and toxicology reports ... the West Palm Beach police officers were not responsible, nor was their use of force responsible, for Donald Lewis' death -- his ingestion of cocaine was, said Krischer."

What amazes more is that the attorney has taken this case on. It's clear to anyone with half a brain that the cops and the camera crew aren't culpable in the crack-head's death, and chances are that he's taken the case on a no-win, no-fee basis. Which means he's out of pocket and they are both dumbasses.

Because lawyers are vultures. The lawyer gets paid either way, so he'll take anything to court as long as he gets paid.

I've never been a big fan of cops, but this is ridiculous. Anyone who views that video can clearly see that the guy OD'd. The officers seemed very concerned when he stopped breathing and then tried their best to revive him. That man committed suicide, whether it was intentional or not.

No offense to gents the caliber of Hall120, but there is a point here. Some attorney's are nothing more than ambulance chasers . . .

More baffling is that a court is actually going to hear the case!  boggled  crazy

I suspect this lawyer has taken the case on a contingency, which means he gets nothing unless they get the state to agree to a settlement.

Common tactic of ambulance chasers - bring a lawsuit, knowing it is frivolous, counting on the respondent to agree to an out of court settlement as being cheaper than a protracted period of litigation.

Lawyers like this clown are a pox on the profession.

LOL, no offense taken. Sadly, we do a lousy job at weeding out those that bring discredit upon the profession.

Come on, papa, we've been over this a long time ago. I HAVE been in several situations where I needed them and they've never offered any assistance. (Street cops, that is. The FBI is great!)

But anyway, I feel really bad for the officers in this video, they were visibly shaken by this guys death and tried their best to help him. And obviously they had to use force to subdue him because of the way he was acting, but that's not what killed him.
