Just Got Stopped For Speeding (CA).

It was my friend.

Heres the info:

2000 Honda Accord
79MPH in a 55MPH Zone
He is a minor
First Ever Ticket
Vehicle Code was 22349(b) INFRACTION (one pointer)

This happened in Santa Barbara County, CA.

How much do you think the fine will be?

From what I remember it will be $12 for every mph over the speed limit then a penalty assessment of 50% on top of that so... around $430 or so.....but it has been a long time since I got busted.

Thats not how it works... they issue a "notice to appear" and then send you the actual ticket in the mail.

Isn't that speed difference a felony? At least the urban legand in my head said anything over 20% or some other % is a felony.... Cops?

No. Not even a misdemeanor. Just an infraction. In CA, VC 22349B is exceeding 55 on an undivided highway. One pointer. 22348 is exceeding 100 MPH which is still only an infraction. Reckless driving is a misdemeanor which does not really have much constitute on speed, but you actually endangering someone or yourself.

No... I guess I should have started out to explain that CA is MUCH different than any other state and people are clocked at 100MPH every day and it is only a speed infraction, no reckless driving/operation.

I am the uncle, he is allowed to drive to/from school. Not that bad of a punishment. If I was that young and got a speeding ticket, I would like to stay off the roads as much as I could anyways.

Junior licenses may have additional penalties applied to them.

I know of someone who was doing over double the speed limit and he didn't get anything except two or three points and maybe a $150 fine.

I'd really recommend your friend "fighting" the speeding ticket. If he gets points, his insurance will go up drastically.

I didn't use that, but they will at least pay for your ticket if you lose - and its only $17. Also, if your friend knows any lawyers/police officers, give them a call ASAP. Sometimes they'll be able to speak to the officer and negotiate the violation down. Even if you don't know a lawyer, it may actually be worth hiring one rather then paying the ~ $150 ticket and probably the few thousand in elevated insurance premiums.

For example, if you're pulled over in PA (not sure how it works in other states), you can get two violations. One is speeding and your penalty is dependent upon how fast you were going over the speed limit. The other is called "failure to obey traffic control devices." Since this isn't a moving violation, there are no points attached this. This means (in PA, at least), your insurance company won't find out. Plus, the fine is only about $110.

How was the weather? Night or day? Was your friend wearing his seatbelt? Were there any other people in the car? Were they wearing their seatbelt? Was there a lot of traffic? Was he respectful?

If all of the answers to that are good, it might be a good idea to fight it. Here (once again, in PA at least), magistrates have a reputation for reducing/eliminating charges for anyone willing to show up to court for a half an hour.

That is awesome.

Anyway about your friend, if he really does not want to the ticket or have it on his record he can always get a traffic ticket lawyer and take the fine to court. I have a friend who got 120mph in a 55mph zone and wreck less but it was dropped to a 10mph over ticket by having a good traffic lawyer and he but he also spent $1500 on it but that better than have wreck less driving on your record.. Here in South Florida there is a thing called Ticket Clinic which gets rid of your tickets and off your record most of the time. 79 in a 55 is not horrible so a lawyer or something like Ticket Clinic should work. Tell him to look into that too.

First offense, both your friend and one of his parents will have to go to traffic court held at Juvenile Court, and he will be directed to attend traffic school. Not sure if its the same with juvenile's or not, when I last worked the cost of traffic school was the same as paying the ticket, of course the advantage is no citation on his record which would send his insurance rates into outer space. Fine depends on the county so Santa Barbara could be more than lets say San Diego County.

For being almost 30mph over the limit that is hardly being a jerk, that is being practical. In some states they call that "reckless operation" and would have (should have) arrested him for going that fast. Your friend is incredibly irresponsible.

Pay the fine, in most states they don't let you do defensive driving for more than 20 over. You can take it to court though and hope the cop doesn't show up. However, if it was a bigger department don't count on it. Chances are they have a traffic division and the officer in question was part of it- so it is his mission in life to show up and make sure that ticket sticks.

Cali (from my experience) - hardly any cops to be seen on Highway 101, but when people get pulled over (and, thankfully, I haven't), the fine stinks (well, it does anywhere, so).

That's usually the case from what I know - 20 and over and your penalties skyrocket as opposed to a speeding violation under 20 mph.

Just out of curiosity, where was your nephew, the 101? The reason I ask, my cousin's son was on the 101 back in 2000 and he got pulled for just about the same thing, an 18 yr old at that. That episode ran about $350 and he had his license pulled for 6 months- by my cousin. He hasn't had a ticket since.  Wink

I am 24, I did not get pulled over. It is my half-brothers son. Because of our close age difference, I always refer to him as my friend and not nephew. Is there any other personal questions we need to clear up?

I just went on to SB Countys website, typed in his DL number and the fine came to 217.50. Then traffic school to a grand total of $255.55.

Ha, juveniles here have to go to court with the officer, plead their case, and sisnce usually the ticket still stands, the fines still get paid.

Wish we had the option.

My first, and only, speeding ticket was for much the same situation, though I was only doing 75 in a 55. At that time (1996) the fine for such a stupid act was just shy of $100. No traffic school option, just pay the fine or go to court. Since I had no excuse, I paid the fine. Since then though, NM as now added the points system and I think adjusted the fines.
I lift things up and put them down.

We all go that speed sometimes. I do it... but not knowingly. The highway where he was stopped (246) can be very empty at times and there is a very long 4 mile straight stretch followed by an upward hill and then gradually down. There was no one in sight, he was not paying attention to his speed, and was caught at the crest of the hill. Just a mistake, he needs to be more alert of his speed.

A lot of you said reckless driving, which is so not the case. In CA at least reckless driving is defined as you KNOWINGLY putting yourself or someone else at harm by driving carelessly. Not just for accidentally speeding.

I do not drive drunk ever because I don't get drunk ever. And there is a difference. You do not have to remind me that speeding is dangerous. I witnessed a motorcyclist crash (also on 246 where my nephew was stopped) and die all by himself. I saw him dead lying in the middle of the road.

Also, the speed in that my nephew was not reckless. He made a mistake. If 79 MPH was an unsafe and reckless speed, you would never see these:

If 79 MPH was SAFE and LEGAL where he was at, he WOULD HAVE seen one of those. Are you telling me 79 MPH is safe on an urban neighborhood surface street? There's a hell of a lot of difference in the amount of traffic and the roads where the pictures of the signs you posted were taken and where your relation got busted. I know where those pictures were taken because I live not far from there and even though those roads are designed for those speeds I see the results all the time of people who were driving within those speed limits and had a small mechanical problem or a moment of inattention- it usually results in death.

Not to mention the fact that what he did was just illegal. 55 MPH doesn't mean 55 for some and 79 for others or 55 right now and 79 in the middle of the night.

Everyone should be given a speeding ticket if they have been caught speeding, no exceptions and this bloody well includes fellow police officers.

Personally, I speed all the time, and if I get a ticket, I get a ticket and pay for it, I don't have a problem with that. However, thank goodness for modern technology, and since I've purchased my radar detector 10 years ago, I've only been caught twice, interestingly enough the only two times I forgot to turn the RD on.

Oh yes indeed, you can get a reckless for excessive speed. It is at the discretion of the officer and there was recently a newspaper article about the rising number of arrests for speeds in excess of 100, so don't think you will get away with it.
Your claim about "accidentally speeding" is hilarious. Try that one n the judge. If he didn't knowingly speed, then he wasn't being aware of his surroundings and sounds like he was putting himself and others at risk. The sign says 55, his speedo says 79, where's the accident? If they have the speed lowered to 55 on 101, there is a reason, probably going through a congested area. 101 through San Bernadino County is well known for its traffic enforcement, I got one myself once. I-5 everytime now.

He was not on 101 and there was not a congested area. Just the opposite. He was in the middle of the damn desert. You know long 10 mile stretches of nothing but asphalt, not a soul in sight. It is very hard to keep it at 55 mph in that situation. 79 even seems slow.

My condolences then. I also mixed up San Lois Obispo County. Maybe he should buy good a radar detector. Still not an accident though.

I could understand using the hill as an excuse if you got caught at the bottom of the hill....but caught at the crest? That would mean that were it flat ground he would have been going far more than 79.....

I think that going up the hill, you lose some speed, so you accelerate harder, and once you are at the crest, and you start going back downhill, you speed up because of two factors. 1. you are going downhill, and 2. you were accelerating harder because of going uphill.

I do not know exactly where he was caught, but from what he tells me, and had started going down the hill a good 200 feet while the cop was going up. You have to understand, this is a very large hill.

In Connecticut, 20 or more MPH above the posted peed limit is considered reckless driving and automatically gets you a mandatory appearance before a judge in Superior Court who sets the very hefty fine.

I have lived in New England, and it is so much easier to speed in CA because of the long straight roads that are very deserted.

Did you read all the posts, he was pulled over in the middle of nowhere on a long 10 mile stretch of straight-away. On these roads, it is so easy to go 79. 79 still seems like you are getting nowhere.

Forget the lawyer. He should just plead not guilty, show up himself for the hearing and talk to the prosecutor/DA who will offer him a deal to lower the points. It worked for me 2 years ago, and I'm hoping it will work again with the ticket I just got on Saturday on I-95 in Maine. As long as I can get it down to 4 points it doesn't affect my insurance!
