London Smoking Ban: The End For Shisha Bars?

Fri Jul 06, 2007 9:54 am

Interesting article. I think that this whole anti-smoking cause has been taken a bit too far. I can understand why smoking in bars and restaurants is not allowed for second hand smoke reasons, however the only reason why people frequent Shisha bars is to smoke.

I find this interesting, as a lot of places in the US now have smoking bans in bars, but Shisha/Hookah bars are still given some sort of an exemption.

As far as I know, 'shisha' bars and businesses are not exempt from the New Jersey or NY City laws as to no smoking in any publicly accessable business or workplace.

I'd be curious to see how cigar lounges are affected. Once again, it seems silly to ban smoking in a place that is frequented specifically for that reason.

While certainly the new ban cannot be argued against in general for health reasons, surely anyone going to or working in a sisha bar will know that smoke will be involved.
It's not like a pub after all, they don't sell booze either.
Interesting the NY could be flexible.
Those who frequent such places, of Arabic descent mostly, are also not likely to be zealots bent on bombing!
(The bars are mostly on London's Edgware Road, long a focus of the Arabic/South Asian community).

There was a plan for a flexible application of this inevitable law, though whether sisha bars would be included is not clear , however, the recently replaced Health Secretary, Patricia Hewett, was the very epitome of a finger wagging, matron like, posh, patronising, bossy-boots.
Having said that, until this issue came up with the ban, I did not know London had such places, didn't really know about them at all really.

In Ohio smoking is banned in ALL places of business. The exceptions are listed below.

A business that sells tobacco and is located in its own structure and was in business before the anti smoking law was past.
A family owned business that does not have any employees other then family.
A bar where there is no roof and no more then 3 walls.
It's not a near miss it's a near hit!!

In Germany, where a general ban on smoking in bars and restaurants is in the making, this issue has not been thought out either. Only the state of Hessen has announced to exempt Shisha bars; in the other states, they will apparently be banned as well. A pity for the many Shisha bars in Berlin especially. I wish lawmakers could consider it before the ban comes into effect probably early next year.
I for one am looking forward to the ban!

Have been in many NYC shisha places since the smoking ban and they were most definitely open, so yes they do have some exemption there.

Sounds like a shisha bar to me

Anyway, the way this is handled in California, the first major anti-smoking jurisdiction is very simple. If your place has a patio or open floor to ceiling windows that are open to the outside, it is legal in those places. You can't have tobacco being smoked in enclosed places. I think this is entirely reasonable and allows the greatest flexibility.

I remember when Boston enacted their smoking ban in May 2002, I believe the law made exceptions for establishments that made more than 40% of their income from tobacco-related products, essentially cigar bars. I don't know exactly what the text says for the Massachusetts law that came into effect in July 2004, but I know cigar bars are excepted from the law, so I'd imagine that would extend to shisha bars as well.
