Govt Needs To Use Its Brain

I'm no fan of anyone breaking the law but this just seems wrong. The guy works 11 years busting his ass. Saves $59,000 and because he didn't file a form, the government is going to crucify him.

Hardworking people like this who take personal responsibility for their financial future is exactly the type of people we need in this country.

It seems to me that someone within the Justice Department needs to get their head out of their ass and do the right thing here.

Zapeta admits he never paid taxes.

Wonder why this comment is in the article? At his salary he wouldn't have to pay income tax although he would still owe Social Security and Medicare payments.

Just fine him and move on, this is one of the problems with asset forfeiture laws, take the money now, and put the burden of proving your innocent of any wrong doing in earning the money on you.

Absolutely. But the punishment isn't because of that act.

I believe it's US DOJ policy not to criminally prosecute people for being here illegally. The punishment is civil deportation.

Tough situation...I feel bad for the guy because all of that money was the product of hard work, but he is here illegally and never paid a dime in taxes. The IRS should take its share of the back taxes on the $59,000, plus tax the donated money, charge him whatever fines go along with the failure to pay tax, and let the guy go home with what he's got left. At least Uncle Sam gets what is owed and the dude doesn't go home empty-handed--the guy can document that the money is not a product of unlawful activity like drugs.

As an aside, the guy's been here for 11 years and speaks *no* English? You have to try hard to not pick up the language after 11 years.

Sorry for my nerdy chiming in here, but it's actually quite common for immigrants, especially illegal ones, not to pick up the language of their host country for years. When you're illegal, you tend to stick to your own community, watch TV in your language, do your shopping at a convenience store where the staff speak your language. I used to make a good living tutoring immigrants in Brussels who'd been here for 20 years and knew only a handful of words. Sad, but true.

Part of the law that I don't like, why doesn't this guy have to prove it wasn't from illegal activity, it should be on the government to prove that it was.

Very true, is also true of older immigrants; see the ads in Spanish, Korean etc.

And why don't we go one step further and fine the companies like Wal-Mart, Best Buy that sell items to illegals. Remember when they purchase something at the store THEY ARE PAYING TAXES. Can you imagine what would happen to the state budgets of California, Arizona, Texas and Florida if the illegals were all gone, and the sales tax collected dropped by 20%?

In no way am I denying that. But I think the punishment should fit the crime. I think this guy should be deported but it seems grossly disproportionate to take $59,000 from him when thousands of illegals are caught and given nothing more (if anything) than a slap on the wrist.

Nope. According to the IRS, to qualify for the Earned Income Tax Credit, you need to have a valid Social Security number, and be under the income thresholds. Since this guy doesn't have a SS number, and probably earned above the single taxpayer with no qualifying children threshold ($12,120 for 2006), it is highly doubtful that he would be eligible for that. He owes.

I'm just guessing, but when you try to take $59,000 out of the country without declaring it, in violation of US law, that probably creates a rebuttable presumption that the money comes from illegal sources or is being used for illegal purposes.
