Sotomayor Confirmed!

Thu Aug 06, 2009 7:30 pm

Regardless of your political ideology, I think this is a celebratory moment that this country has come to an age where our highest court, as well as the entire judiciary as a whole, is looking more like the country at large.

Congratulations, JUSTICE Sotomayor.

Why ? because she is Hispanic ? or Empathetic ? Really not that ground breaking unless you are surprised that a Latino can actually make it to this level ... I am not .

AGM, I actually empathize with your position.  Wink (Sorry, couldn't resist the use of that word.)

Personally, I see it quite similarly to how I see the election of Obama. Does it mean that we today have changed? No. It doesn't. It's evidence that change has already occurred. And that's a good thing!

I think you would agree with me that the past has not been kind to many minority groups, and that in large part, the present shows that minorities are more integrated than ever. We're not all the way there, but we're well on our way to being the more perfect union our founders wanted us to be.

So is this confirmation groundbreaking? Yes and no: yes in that we have finally broke the ground, but no, in that it is not proof that we could not have broken ground until this moment. Yes in that a Latina has taken the stage, no in that this country was poised possibly for a long time to recognize that a Latina can make it to this level.

I'm also not happy and think it's a sad day for the US justice system.Sotomayor is just to radical for my taste.I think she got a free ride and the same criteria was not applied as with others judges. But that's the democrats way.

Congrats to Justice Sotomayor - hopefully she will judge fairly and not let emotion dictate her decisions.

Kudos to the Republicans voting against her for keeping the whole process civil and professional.

True. But the writing was on the wall already before the first hearings were cast. But to have the Repubs due an all out negative media blitz on Sotomayor was simply not good politics.

Here's who they are: Lamar Alexander (TN), Kit Bond (MO), Susan Collins (ME), Lindsey Graham (SC), Judd Gregg (NH), Richard Lugar (IN), Mel Martinez (FL), Olympia Snowe (ME) and George Voinovich (OH).

Worth noting, the only Latino Republican in the Senate voted in favor of Sotomayor.
So I guess the Republican lynch mob are going attack Latinos now.  Yeah sure

My Mistake , correct . Its hard to imagine how Justice Marshall achieved what he did in such a time as he lived in. Pretty tough guy , It always amazes me too read about African Americans who achieved so much while others were living with no rights at all. How did they go to University , Become Doctors , Lawyers , Scientists and Start companies , achieve so much while other African Americans were so oppressed. What made them different..

Her overall record demonstrates that she does judge by the facts and not emotions. You can argue those facts but that is what judging is all about. It is people's fears that are causing them to question if she will be a fair and straight forward jurist to sit on our Supreme Court.

Quoting DXing (Reply 17):

I think they felt it was a good nomination and they agreed with it. Otherwise the Republicans could be accused similarly on Roberts, since they all voted (in lockstep?) to confirm Roberts (as well as the lone Independent; the Democrats split evenly, 22 for and 22 against).

Well they have 40 and there is a good 10-12 conservative Democrats from southern and rural interior states that could have been persuaded to vote against. That didn't happen because she is well qualified for the job.

40 is not good enough and woulda coulda shoulda does not count as a vote. They voted for the Justice. If the situation were reversed the GOP would have been branded as voting in lockstep, rubberstamping, rolling over, etc. etc. as has been done so many times in the past. Personally I am happy, but believe that she may surprise some people from time to time. I like the idea of having 3 strong conservatives, 3 strong liberals - giving us 6 who will present arguments with vigor. Then lets have 3 with strong common sense as well as a mastery of the law who will swing decisions the way this country needs them to go.

He consistantly said that unless she had a complete meltdown during the judicial hearings he would be voting for her so it was pretty much a given. Alexander surprised me, Vonovich did not. He was a very good Mayor, an ok Governor, but he has just been a huge disappointment as a Senator when it comes to conservative fiscal positions.

Not surprising on a near-party line vote.

But the damage to this country and the USSC could be much worse. She at least is replacing another left wing nut, rather then somebody like Thomas and Souter who actually are good jurists.

Closer to 15 percent, but you're missing the point. Don't look at Sotomayor as one Latina out of 9 justices, but as one Latina out of 111 justices throughout American history - clearly, her demographic has been underrepresented. Her appointment is a sign that we are overcoming the inequalities that led to that underrepresentation.

Quoting AGM100 (Reply 37):

That's kind of the point. They weren't considered because they were being blocked, sometimes overtly, more often due to underlying social inequality.

You're missing the point entirely. Puerto Ricans were banned from apartments owned by white NYC landlords routinely for years following WWII...Latinos had their houses and property confiscated by white police in Los Angeles for all manner of minor infractions - not to mention the building of baseball stadiums. Much of my maternal grandfather's time in the USN during the Korean War consisted of comments from white officers like 'where you from Garcia? You're too white to be a taco vendor!'. The racist La Raza movement fomented as a response to racist policies in the California and Arizona state legislatures well into the 1970s.

It's historic because with the negative precedent set in years past, both Latinos and whites have moved past that sordid history to where things are now. Better than before by a mile.

All that said, I don't really care for Sotomayor personally, but I wish her success on the Court.

He consistantly said that unless she had a complete meltdown during the judicial hearings he would be voting for her

No, he said that barring a meltdown, she would be confirmed. That wasn't saying from the outset that he would vote for her. He made that decision after considerable investigation and deliberation. Give one of your own some credit, for heaven's sake!
I'm not dumb. I just have a command of thoroughly useless information.

For her to vote for the city and against the firefighters who deserved the higher ranking after doing well on the test is not someone I want on the bench of the supreme court.

I think you have bought the Republican propaganda on this case. You can disagree with the law (which is a very reasonable position), but you can't disagree that the case at the Second Circuit followed the law. It was not a constitutional case, but rather a statutory case. The Supreme Court has since changed the law.

Quoting AGM100 (Reply 37):
She is a Liberal ... that is clear.

Actually, there are some *real* problems labeling judges liberal versus conservative. Judicial ideology is a very different animal from political ideology. There are some issues (such as the constitutionality of police interrogation tactics) where Sotomayor would be labeled very conservative in a political ideological way, and believe it or not, Scalia becomes one of the most liberal justices. So, let's just be careful throwing that word around. It isn't exactly appropriate.

And, of these the most impressive is Lindsey Graham. A lot of people in this country were looking at him for guidance because of the level of respect he brings.

What I find most interesting is just how many Republicans voted for her twice before: once when she was appointed to the District Court, and again when she was elevated to the Court of Appeals, but for whatever (political) reason decided that they were wrong before, and should vote against her now.

I guess the Republicans were for her before they were against her.  Wink
