CA DMV Employee Harasses Transgender Woman

Fri Dec 10, 2010 7:39 pm

Absolutely disgusting - another further example of how government workers don't have to play by the same rules as everyone else. If you or I took confidential information we came across in our work and used it to harass someone with religious or any other paraphenalia, we'd be shown the door.

A few days after Amber Yust visited the Department of Motor Vehicles in San Francisco to register her sex change from male to female, she got a letter at home from the DMV employee who had handled her application.

Homosexual acts, he informed her, were "an abomination that leads to hell."

I don't think this has much to do with the California DMW as it does with someone expressing their disgusting opinions. This person is probably used to this treatment, just as I am used to hearing this type of crap in small Oklahoma towns. Not so much in cities. I was once told that I should be castrated so that I wouldn't reproduce any more homosexuals. (?)

I hope the person gets fired, and I hope the transgendered does not turn it into a big lawsuit.

I absolutely hope the transgendered DOES turn it into a big lawsuit. The DMV employee STOLE HER PERSONAL INFORMATION, harassed her at home, and also passed the info on to some fundamentalist church, who harassed her via mail at home! WTF?!

The thing that really gets me is (paraphrasing) that the spokesperson for the DMV said it would be a learning experience for everyone.

Cut the politcally correct bullshit. This whack job employee should be terminated immediatly. A learning experience would be like whoops I keyed in the wrong address. Not something at this level.

You would think this employee comes across all sort of characters working in SF but guess not.

I want to sue the DMV for sitting on their thumbs.....

That's my gut reaction but any settlement will come out of taxpayers' pockets. I'd much prefer if she sues that the DMV turn around and get a judgment to have this guy pay restitution out of pocket.

Well that would be nice and I hear what you're saying, but unfortunately he was an employee and agent of a state agency... if he were employed in the private sector (such as at a bank or something), certainly the private employer is liable. On top of that, the DMV's response doesn't exactly communicate that they even give much of a krap. However, considering CA is broke, if she does get a settlement, she probably won't ever see a dime of it anyway.

I absolutely agree - a state agency needs to do more to ensure it has law-abiding people employed in positions with access to citizens' personal identification information.

The DMV employee STOLE HER PERSONAL INFORMATION,

I believe that this may actually be a felony. If not, it's certainly skirting the line of identity theft (stealing somebody's personal information from protected state records). It's possible that the DMV employee could be prosecuted for it.

I think that the fact that this employee has already done this once before surely must leave the DMV with no choice but to terminate them ( as should have happened the first time )

Now hold on. I'm no fan of government, but as a Californian, I will tell you that our DMV is actually pretty good. Wait times are relatively short (typically you're in and out in well less than an hour) and service is usually courteous and efficient.

This has nothing to do with government and everything to do with one worker who should be fired for violating state and DMV non-discrimination policy.

Are you serious? In my 21 years as a California resident I've only known DMV to be a major source of contempt. The only real improvement I've seen since leaving is putting many functions online.

Hawaii's DMV has excellent service and even has satellite offices near major employment centers so that people can get paperwork in / take exams without having to make a special trip to their main locations.

As compared to NY or MI, the other two with which I have experience, I have found CA's DMV to be a dream.

Transferring a title of a car is easy. But every time I've had an appointment I've had to wait at least 30 mins. (Then why have an appointment?!) But yes, much better than waiting 2 hours to do the same.

In other news, DMV has finally caved and announced today that the guy who did this to Ms. Yust has been on admin leave since October...although with pay. Grrrrrrrrrrrr.

In California, you can even go to AAA to have much DMV stuff taken care of. Its really not bad.

That is a normal procedure in every state and federal agency. They have to undertake a proper investigation.

I can only speak for NY, but as long as you aren't in the city normally things are ok. The staff may be a bit on the mean side, but I have rarely waited more than 5-10 minutes at the DMV in the suburbs just north of NYC. I have found the trick though is to make sure everything is perfect, because if you forget to fill anything out, it is the back of the line. Not horrible as the wait isn't too long, but still annoying.

The NYS medical review board on the other hand is an absolute joke. Apparently they only meet a couple of times a month in some back room in Albany and you cannot ask any questions about your application. You just have to hope that everything went through correctly. Luckily I don't have to deal with them anymore.

Not saying this is specific to you, but I just find it funny - I bet that a lot of people who defend what Wikileaks is doing somehow are all outraged with this breach of confidential information.

OMG! First it was Dreadnought and now I'm agreeing with you!(lol)What's up with that?(lol)

But in general.....
There are bad seeds and or employees who turn bad in every sector of life. And if every company, public or private, presented and trained awareness programs and polices to each of it's employees, then I don't feel a company,or in this case, the DMV is not liable. But I do believe possible criminal charges against the employee should be looked in to.Stealing private info, for example.

But knowing when I do jury duty, what's the first thing you see? An awareness tape.

I also think this guy needs a lesson in relative morality; he may have objections to the way this woman is living her life, but it is also immoral to break the law; he may attempt to rationalise his actions, but hopefully the Court will see that the message is put across quite clearly.
