Mothers Ask Japan Not To Sign Hague Convention

Oh boy, here we go! Japanese mothers claiming domestic violence was their reason for kidnapping their kids and escaping to Japan, what will they think of next? Japan is the only modern country that has not ratified the Hague Convention and I have a sinking feeling the histrionic testimony from these mothers may keep that status intact. Nevermind that some Japanese women have been known to take their kids without warning, against orders from the US and Canadian and Australian governments, with their fathers NEVER TO SEE THEM AGAIN.

Is it just me or are they just a teensy bit glossing over the fact that the US or any other government would never force their children to remain with a parent who had been investigated for abuse??

one woman told reporters she began to find inexplicable bruises on her child after her ex-spouse's visitations. She said her child asked to be taken to Japan.

"If Japan were to sign the Hague Convention . . . (my child would) be forced to live with an abusive father and be exposed to violence again," the woman said. "And I will become a (declared) criminal."

Some may recall this came to a head after a woman, dissatisfied with life in the US following a divorce, defied court orders and kidnapped her kids to Japan from Tennessee in 2009. Her ex-husband was arrested when he showed up in Japan seeking custody of the kids.

I know of a case here in New Jersey where a Family Court Judge had to go to Brussels, Belgium due to a parental child abduction of a USA citizen child. Because both Belgium and the USA are signers ot this Hague Convention on this issue (there a number of other related Hague Conventions as to legal procedures and recognition of ), they could protect the rights of the USA parent to get the child returned to the USA custodial parent. In another NJ case, the father took off with the child to Jordan and it took a US Senator to break the deadlock due to the lack of the Hague Convention and bring back the child to their legal custodial parent per USA law . A couple of year ago there was a complicated case where a Brazilian mother took her child to Brazil home and it took the father years in the courts down there once again due to the lack of the Hague Convention. This Hague Convention came to be in a very public case about 20 years ago where a DC area woman ran off to New Zealand with her child to where her mother lived claiming that her husband had be abusive to the child and refusing the DC court's rulings in favor of the father.

Many countries do not recognize the USA courts as to child custody, giving priority to the parent who is a citizen of their country. Japan continues to be one such country but even several EC countries do so as well. Time to be part of the modern world and recognize the legitimate authorities of our courts just like we have to recognize yours on such and many criminal and business matters.
